Governance

FSI's research on the origins, character and consequences of government institutions spans continents and academic disciplines. The institute’s senior fellows and their colleagues across Stanford examine the principles of public administration and implementation. Their work focuses on how maternal health care is delivered in rural China, how public action can create wealth and eliminate poverty, and why U.S. immigration reform keeps stalling. 

FSI’s work includes comparative studies of how institutions help resolve policy and societal issues. Scholars aim to clearly define and make sense of the rule of law, examining how it is invoked and applied around the world. 

FSI researchers also investigate government services – trying to understand and measure how they work, whom they serve and how good they are. They assess energy services aimed at helping the poorest people around the world and explore public opinion on torture policies. The Children in Crisis project addresses how child health interventions interact with political reform. Specific research on governance, organizations and security capitalizes on FSI's longstanding interests and looks at how governance and organizational issues affect a nation’s ability to address security and international cooperation.

Abstract:

Community-driven development programs that decentralized administrative, fiscal, and political functions have become a popular policy tool to deliver public services.  We study a large reform in the city of Delhi that decentralized the management of discretionary school budgets to elected bodies of parents.  Using household surveys, non-participant observation in schools, semi-structured interviews, and administrative data we ask if decentralization has brought expenditures closer in line to the preferences of parents?  We find that expenditures are heavily skewed to the preferences of more traditionally powerful actors, namely men and members of the government bureaucracy.

Emmerich Davies specializes in education policy and politics, the political economy of development, and the politics of service provision, with a regional focus on South Asia.  His work has been published in Comparative Political Studies.  His book manuscript examines the growth of non-state service provision in low-income democracies, and the consequences for democratic politics. Davies earned his B.A. in Economics and Political Science with honors from Stanford University in 2007, worked for two years for the Abdul Latif Jameel Poverty Action Lab in Kolkata, India, and Ph.D. in Political Science from the University of Pennsylvania.  He is on leave for the 2019-2020 as the W. Glenn Campbell & Rita Ricardo-Campbell National Fellow and the Susan Louise Dyer Peace Fellow at the Hoover Institution.

Abstract:

At any given moment there are hundreds of international negotiations being undertaken in numerous institutions and forums, touching upon every legal and social aspect, including cyber, trade, terrorism, telecommunications, environment and human rights, just to name a few. International investigation and monitoring groups, and international committees and specialized bodies, are routinely created, subjecting states to investigations and reviews. States are subject to strict reporting requirements, having to submit hundreds of detailed reports a year to different institutions. International courts and over 160 international dispute settlement mechanisms are at work in their respective areas– creating new bodies of law, and thousands of professional committees whether in economic blocs, international institutions, or other forums, are revising and creating new international norms. Black lists are being formed, alliances changing, and new actors, including multinational corporations, are now an integral player of the international arena.

The challenges states are facing in building capacity and training personnel to deal with this vast and evolving international scene are formidable, requiring substantial funds, human capital, leadership, strategic planning, specialized education, and extensive inter ministerial cooperation, just to name a few. Ramifications for a state for lack of capacity may be huge.

This talk will seek to take a birds eye view of the evolving international arena, and focus on some of the challenges states, particularly developing countries, have in building their capacity to enable effective navigation in this sphere. The talk will showcase the International Rule Making Project, which seeks to assist in the development of global tools and policies. The talk will also address the increasing participation of China, who openly seeks to reshape global governance, as a strong player in the international space, and the possible interconnections between all of these issues.

Dr. Shavit Matias was Deputy Attorney General of Israel in charge of international issues. She and the teams she led formed and implemented a strategic plan for Israel to deal with globalization and the numerous international institutions and forums. She formed and headed the Department for International Agreements and International Litigation, which deals with policy and law, globalization, international institutions, negotiations of bilateral and multilateral international agreements, joining international organizations, international investigations, and international litigation and arbitration in international forums. She spearheaded changes in inter-ministerial cooperation, training, and decision-making processes throughout government.

Dr. Matias regularly advised Prime Ministers and the Government on policy and law regarding international matters. She was a member of Israeli National Security Council teams on a range of national security challenges, national strategy building, international law, Middle East policy, counter-terrorism, and international conflicts. She headed inter ministerial committees, and worked with colleagues from around the world to develop international mechanisms, international tools, and law.

Matias represented the State of Israel in United Nations committees, international investigations of Israel, international and foreign courts, and co-headed Israel’s inter ministerial task force on matters relating to universal jurisdiction and issues relating to the laws of war. She represented the state in numerous bilateral and multilateral negotiations, including complex trade matters with the EU, joining the OECD, permanent-status issues with the Palestinians, and as a member of Israeli-Palestinian joint committees. She was also a member of Israeli government teams working with the international donor community on matters of Palestinian institution and capacity building, and a member of numerous policy teams.

Since 2014 she heads the Global Affairs and Conflict Resolution program at the Lauder School of Government IDC, and teaches courses on globalization, diplomacy, law, and conflict resolution. She is also on the Professional Advisory Board of the International Institute for Counter Terrorism. She is a recipient of the 2008 Award from Georgetown University Law Center for Outstanding Achievements in the Profession, and in 2017-2018 served on the President of Israel’s Committee for Doctoral Grants for Academic Excellence and Scientific Innovation.

Between 2013-2018 she was a fellow at the Hoover Institution and since 2018 is a visiting scholar at CDDRL heading the International Rule Making Project geared at developing global international tools enhancing good governance, rule of law, capacity building, and economic growth particularly in developing countries and areas of conflict.

Matias is a member of the Israeli bar and the New York bar. She clerked at the Supreme Court of Israel, received her LLB from Tel-Aviv University, her LLM from Georgetown University, and her Doctorate in International Law (S.J.D.) from George Washington University under the supervision of Judge Thomas Buergenthal.

About this Event: Israel’s relations with the Arab countries of the Persian Gulf, and particularly Saudi Arabia, have been improving for many years. Saudi King Faysal famously handed out copies of the anti-Semitic Czarist forgery, The Protocols of the Elders of Zion, to his visitors, but today the leaders of Saudi Arabia, Bahrain, Oman, often make positive statements about Israel and the Jewish people. Prime Minister Binyamin Netanyahu paid an official visit to Oman in October 2018. Unofficial meetings are reportedlyheld often with Saudi leaders. A synagogue now operates openly in Dubai, and EXPO 2020 Dubai will feature a full-blown Israeli pavilion. Qatar will likely let Israelis attend the FIFA World Cup in 2022. The Gulf countries are interested in access to Israeli technology for civil and military use. Never full-fledged supporters of the Palestinians, particularly after the Palestinian leadership supported Saddam Husayn in the Gulf War, Gulf leaders see an opportunity to cooperate with Israel against their common enemy –Iran. With doubts about US commitments to the region getting even stronger, the Arab countries of the Persian Gulf will look to increased cooperation with Israel, as well as Russia and China.

 

Speaker's Biography: Prof. Joshua Teitelbaum is a Visiting Scholar at CISAC. He is a leading historian and expert on the modern Middle East. Teitelbaum teaches modern Middle Eastern history in the Department of Middle Eastern Studies and is Senior Research Associate at the Begin-Sadat Center for Strategic Studies (BESA), at Bar-Ilan University in Ramat Gan, Israel. For many years he was a Visiting Fellow and Contributor to the Herbert and Jane Dwight Working Group on Islamism and the International Order at the Hoover Institution, a Visiting Associate Professor in the Department of Political Science, and Visiting Scholar at the Center on Democracy, Development and the Rule of Law, all at Stanford. He has also held visiting positions at Cornell University, the University of Washington, and the Washington Institute for Near East Policy. His latest book is Saudi Arabia and the New Strategic Landscape (Stanford: Hoover Press), and his latest article is "Saudi Arabia, Egypt, and the Longue Durée Struggle for Islam's Holiest Places,” in The Historical Journal.

Abstract:

As the 2020 presidential campaign begins to take shape, there is widespread distrust of the fairness and accuracy of American elections. Four factors increasing the mistrust. Voter suppression has escalated as a Republican tool aimed to depress turnout of likely Democratic voters, fueling suspicion. Pockets of incompetence in election administration, often in large cities controlled by Democrats, have created an opening to claims of unfairness. Old-fashioned and new-fangled dirty tricks, including foreign and domestic misinformation campaigns via social media, threaten electoral integrity. Inflammatory rhetoric about “stolen” elections supercharges distrust among hardcore partisans.
 
Taking into account how each of these threats has manifested in recent years—most notably in the 2016 and 2018 elections—this presentation concludes with concrete steps that need to be taken to restore trust in American elections before the democratic process is completely undermined.

Professor Richard L. Hasen is Chancellor’s Professor of Law and Political Science at the University of California, Irvine. Hasen is a nationally recognized expert in election law and campaign finance regulation, writing as well in the areas of legislation and statutory interpretation, remedies, and torts. He is co-author of leading casebooks in election law and remedies.

From 2001-2010, he served (with Dan Lowenstein) as founding co-editor of the quarterly peer-reviewed publication, Election Law Journal. He is the author of over 100 articles on election law issues, published in numerous journals including the Harvard Law ReviewStanford Law Review and Supreme Court Review. He was elected to The American Law Institute in 2009 and serves as Reporter (with Professor Douglas Laycock) on the ALI’s law reform project: Restatement (Third) of Torts: Remedies. He also is an adviser on the Restatement (Third) of Torts: Concluding Provisions.

Professor Hasen was named one of the 100 most influential lawyers in America by The National Law Journal in 2013, and one of the Top 100 Lawyers in California in 2005 and 2016 by the Los Angeles and San Francisco Daily Journal.

His op-eds and commentaries have appeared in many publications, including The New York Times, The Washington Post, Politico, and Slate. Hasen also writes the often-quoted Election Law Blog, which the ABA Journal named to its “Blawg 100 Hall of Fame” in 2015. The Green Bag recognized his 2018 book, The Justice of Contradictions: Antonin Scalia and the Politics of Disruption, for exemplary legal writing, and his 2016 book, Plutocrats United, received a Scribes Book Award Honorable Mention. His newest book, Election Meltdown: Dirty Tricks, Distrust, and the Threat to American Democracy will be published by Yale University Press in 2020.

In a talk dated May 31, 2019, UC Santa Cruz scholars Muriam Haleh Davis and Thomas Serres examined Algeria’s recent uprising, which led to the resignation of President Abdelaziz Bouteflika. The talk shed light on the protests, analyzing them both in a historical lens while also addressing the future prospects for democratic change and their implications for regional geopolitics. The speakers explored the role of the war of independence (1954-1962) and civil war (1992-1999) in political contestation, questions of language and national identity, and the landscape of the current political opposition.

In a talk dated October 7, 2019, Georgetown University Associate Professor of Government Daniel Brumberg analyzed the outcome of Tunisia’s legislative election and its implications for democratic consolidation in the country. Brumberg argued that the election provides a vital although not an easy opportunity to move beyond the power sharing, consensus-based political pact negotiated in 2014, to a more consolidated democracy.

Abstract:

Legal compliance has gotten a bad rap in international relations research. Compliance – the state of being on the “legal” side of a legal/illegal binary – has been largely set aside as a variable of interest in empirical studies of international law in favor of more substantive measures of behavioral change. Nevertheless, efforts to frame political science inquiry in terms of law’s effects have not succeeded in sidestepping compliance. To the contrary, none of the core functions of law (guiding behavior, assessing it, attributing responsibility, or assigning remedies) is possible without an applied concept of legal compliance as an orienting point on the horizon. This paper reclaims compliance as an essential concept for the empirical study of international law—albeit in a transformed state that emphasizes its potential for contextual variability and its essentially legal-political character.

“Let’s bring all the planes down”—Secretary of Transportation Norman Mineta’s words to ground all U.S. planes on 9/11—elicited a moment of riveted silence in the audience of educators attending the National Council for the Social Studies (NCSS) annual conference in Austin, Texas, as they listened to Secretary Mineta’s keynote address on November 23, 2019. Upon hearing those words, many were transported back to a time when most people probably remember exactly where and what they were doing at the time that they heard of the events unfolding on September 11, 2001. However, most of their current students were not alive in 2001 and Mineta underscored the importance of teaching them about the lessons of 9/11 so that it is never forgotten.

During his address, Secretary Mineta highlighted the importance of conference themes such as informed action and decision making as he reflected upon lessons from his life, and the important role that teachers have in shaping critical attitudes of their students. In a touching moment, he shared his experience as a 10-year-old boy in 1942 who was forced from his home in San Jose, California, and incarcerated with his family in Heart Mountain, Wyoming, the location of one of the 10 major incarceration camps for people of Japanese descent during World War II. He vividly recalled his cherished baseball bat being confiscated by the Military Police as it was deemed a weapon. Mineta also shared how his experience during World War II informed one of President George W. Bush’s comments immediately following 9/11, that is, “We know what happened to Norm Mineta in the 1940s, and we’re not going to let that happen again.” A son of immigrants from Japan, Norman Mineta became the first Asian American mayor of a major city (San Jose, California). This led to a distinguished 20-year career in Congress and the first Asian American Cabinet member, having served two U.S. Presidents, a Democrat (Bill Clinton) and Republican (George W. Bush).

As Secretary Mineta spoke, one could sense that he never forgot his roots or the shame and humiliation that he and his family felt during World War II; as a congressman, he led the way for an apology from the U.S. government and redress for Japanese Americans who were interned. As U.S. Secretary of Transportation during and after 9/11, he made critical decisions that would ensure that what happened to Japanese Americans during World War II did not happen to any other group based on ethnicity or religion. His burning desire for all people to be treated equally is at the heart of a film, Norman Mineta and His Legacy: An American Story, that was co-produced by Dianne Fukami and Debra Nakatomi, who were also in the audience. The film premiered on PBS earlier this year.

Following Secretary Mineta’s keynote to an audience of hundreds who gave him a standing ovation, SPICE’s Rylan Sekiguchi and Jonas Edman led a more intimate discussion with Secretary Mineta and 70 educators that also included an overview of a SPICE-produced web-based curriculum unit that is titled, “What Does It Mean to Be American?” As its main author, Sekiguchi explained that the curriculum unit consists of six lessons with readings, videos, and assignments to examine key themes from Secretary Mineta’s life and career: immigration, civil liberties & equity, civic engagement, justice & reconciliation, leadership, and U.S.–Japan relations.

Sekiguchi also noted that the curriculum meets national standards for history, social studies, civics and government courses, and topics are brought to life and connected to students’ own lives through primary source documents, interactive classroom activities, and custom-created video vignettes (produced by Fukami) showcasing a diverse range of American voices—from high school youth to former U.S. Presidents George W. Bush and Bill Clinton. Each lesson provides a different lens through which students can examine the curriculum’s central question: What does it mean to be an American? The curriculum unit will be released in spring 2020.

Sekiguchi’s overview was followed by a discussion between Mineta and the 70 educators that was moderated by Edman. Questions from the audience ranged from Mineta’s legendary lifelong friendship with Republican Senator Alan Simpson of Wyoming to issues concerning immigrant families today. Many of the questions and Secretary Mineta’s responses touched upon the political divisiveness in U.S. society today and prompted educators to think of ways to use “What Does It Mean to Be An American?” and Norman Mineta and His Legacy: An American Story in their classrooms. Compliments from the audience like “this was the best session of the conference” and “this was the best workshop I’ve been to” could be heard following the session.

During their work with Secretary Mineta, Sekiguchi, Fukami, and Nakatomi were especially touched when they heard why Secretary Norman Mineta wears an American flag on his lapel. Mineta has noted, “When you’re in close quarters… people will sort of give you the once over. And so, I always wear this [flag pin]. It’s something you feel when you’re doing things. Am I really being fully accepted as an American citizen? I want to make sure everyone knows I am one.”

Abstract:

When authoritarian-era elites return to positions of power under democracy, what are the implications for the quality of democracy? We investigate this question using an original dataset that tracks former authoritarian elites’ capture of high-level posts under democracy across Latin America from 1900 to 2015. We find that when authoritarian-era elites capture a wide range of posts across disparate government branches – spanning the executive, legislature, judiciary, military, and local elected office – such “elite dispersion” undercuts the quality of democracy. It also harms specific dimensions of democracy such as accountability, openness of competition, breadth of inclusion, and egalitarianism. These results are robust to prominent alternative explanations of the quality of democracy, and in particular, explanations that underscore the importance of formal organizations and institutions such as autonomous militaries, dominant political parties, and holdover autocratic constitutions. Elite dispersion matters for the quality of democracy even after controlling for these more visible channels of former authoritarian elite influence.

Michael Albertus is an associate professor of political science at the University of Chicago. His research interests include political regimes, inequality and redistribution, clientelism, and civil conflict. He has published two books, Autocracy and Redistribution: The Politics of Land Reform (2015, Cambridge University Press) and Authoritarianism and the Elite Origins of Democracy (2018, Cambridge University Press), and a host of articles in outlets such as the American Journal of Political Science, World Politics, Journal of Conflict Resolution, and Comparative Political Studies. He also writes regularly for public audiences in outlets like the New York Times, Washington Post, Foreign Policy, and Foreign Affairs.

Michael Albertus is a Professor of Political Science at the University of Chicago and the author of five books. His newest book, Land Power: Who Has It, Who Doesn't, and How That Determines the Fate of Societies, was published by Basic Books in January 2025. It tells the story of how land came to be power within human societies, how it shapes power, and how its allocation determines the major social ills that societies grapple with.

Albertus studied math, electrical engineering, and political science at the University of Michigan and earned degrees in all three in 2005. He then did a PhD in political science at Stanford University, completing in 2011. After a postdoctoral fellowship at Stanford's Center on Democracy, Development and the Rule of Law, Albertus joined the University of Chicago faculty in 2012 and has since been on sabbatical twice back at Stanford, including as a Fellow at the Center for Advanced Study in the Behavior Sciences. In addition to his books, Albertus is also the author of over 30 peer-reviewed journal articles, including at flagship journals like the American Journal of Political Science, Journal of Politics, and World Politics. He has taught courses to undergraduate, Masters, and PhD students on topics including inequality and redistribution, democracy and dictatorship, comparative politics, and political and economic development and policy in Latin America and the Iberian Peninsula.

The defining features of Albertus' work are his engagement with big questions and puzzles and the ability to join big data and cutting-edge research methods with original, deep on-the-ground fieldwork everywhere from government offices to archives and farm fields. He has conducted fieldwork throughout the Americas, southern Europe, South Africa, and elsewhere. His books and articles have won numerous awards and shifted conventional understandings of democracy, authoritarianism, and the consequences of how humans occupy and relate to the land.

Abstract:

 

What explains sustained mobilization — social movement resilience — in the face of severe autocratic repression? This question is especially relevant given the recent uptick in protest movements across the world. We examine this question through the case of Sudan’s popular uprising, which lasted from December 2018 until the country began a formal transition to democracy in July 2019. Drawing on in-depth field research during and after the uprising, we look at the role of organizational legitimacy, elite unity, and the evolution of repression evasion tactics. We find that the movement’s organizational form and mobilization tactics coevolved with the actions of the security apparatus.
