Governance

FSI's research on the origins, character and consequences of government institutions spans continents and academic disciplines. The institute’s senior fellows and their colleagues across Stanford examine the principles of public administration and implementation. Their work focuses on how maternal health care is delivered in rural China, how public action can create wealth and eliminate poverty, and why U.S. immigration reform keeps stalling. 

FSI’s work includes comparative studies of how institutions help resolve policy and societal issues. Scholars aim to clearly define and make sense of the rule of law, examining how it is invoked and applied around the world. 

FSI researchers also investigate government services – trying to understand and measure how they work, whom they serve and how good they are. They assess energy services aimed at helping the poorest people around the world and explore public opinion on torture policies. The Children in Crisis project addresses how child health interventions interact with political reform. Specific research on governance, organizations and security capitalizes on FSI's longstanding interests and looks at how governance and organizational issues affect a nation’s ability to address security and international cooperation.

Abstract:

Enhancing corporate governance has been an emphasis in Abenomics economic reform.  The Stewardship Code established in 2014 has defined principles that institutional investors should follow to enhance the long-term investment return for their beneficiaries.  The institutional investors are now expected to engage "constructively" with the investee companies to increase the corporate value, including discussion on corporate governance changes.  Another related development in 2014 was the introduction of JPX Nikkei Index 400, which is a new stock price index calculated from the stock prices of 400 companies with "high appeal to investors."  Following this, many Japanese companies started to improve their corporate governance and accounting practices to increase their chances to be among the 400 companies.  Now Corporate Governance Code, which defines principles for effective corporate governance, is being developed, adding another impetus for Japanese companies to change.  We invite two business leaders in Japan who have been leading the change.  Kazuhiko Toyama was a member of the committee that drafted the Corporate Governance Code.  Masaaki Tanaka has been pushing the corporate governance reform at Mitsubishi UFJ Financial Group (MUFG), the largest financial institution in Japan.

Masaaki (Masa) Tanaka is Representative Director and Deputy President of Mitsubishi UFJ Financial Group, Inc. (MUFG), the largest financial group in Japan.  He assumed this position in 2012 after serving as CEO for the Americas for the Bank of Tokyo-Mitsubishi UFJ, (BTMU), one of the wholly owned subsidiaries and the principal revenue-generating entity of MUFG from 2010 to 2012, and President and CEO of Union Bank, BTMU’s West Coast subsidiary, from 2007 to 2010.  Mr. Tanaka also serves on the Board of Morgan Stanley since 2011, and currently serves as Vice Chairman of the Board of Councilors of the U.S. Japan Council. In Mr. Tanaka’s current assignment, he directly reports to CEO with general responsibility to oversee all business groups of MUFG, including overseas business.  His responsibility also includes oversight over corporate functions, including corporate governance, strategic and financial planning, and enterprise risk management.  He oversees highly complex business operation with global reach and is responsible for ensuring compliance with all regulatory requirements.  Mr. Tanaka holds a law degree from the University of Tokyo and a Master of Laws Degree from the University of Michigan Law School.

Kazuhiko Toyama is CEO of Industrial Growth Platform, Inc.  He has started his career with BCG and later became one of the founding members of Corporate Directions, Inc. (CDI), a Tokyo-based independent management consulting firm, eventually becoming its CEO. In 2003, he was appointed to lead Industrial Revitalization Corporation of Japan (IRCJ), a government-backed restructuring fund, as COO. In 2007, when IRCJ was dissolved, he founded Industrial Growth Platform, Inc. (IGPI), which he currently runs as its CEO. He graduated from Faculty of Law of the University of Tokyo and holds an MBA from Stanford University. He has passed the Japanese National Bar Examination.

Takeo Hoshi was Henri and Tomoye Takahashi Senior Fellow at the Freeman Spogli Institute for International Studies (FSI), Professor of Finance (by courtesy) at the Graduate School of Business, and Director of the Japan Program at the Shorenstein Asia-Pacific Research Center (APARC), all at Stanford University. He served in these roles until August 2019.

Before he joined Stanford in 2012, he was Pacific Economic Cooperation Professor in International Economic Relations at the Graduate School of International Relations and Pacific Studies (IR/PS) at University of California, San Diego (UCSD), where he conducted research and taught since 1988.

Hoshi is also Visiting Scholar at Federal Reserve Bank of San Francisco, Research Associate at the National Bureau of Economic Research (NBER) and at the Tokyo Center for Economic Research (TCER), and Senior Fellow at the Asian Bureau of Finance and Economic Research (ABFER). His main research interest includes corporate finance, banking, monetary policy and the Japanese economy.

Former U.S. Sen. Mark Udall remembers how members of Congress gathered on the steps of the Capitol Building on the day of the 9/11 terrorist attacks. They clasped one another’s hands and spontaneously broke out singing, “God Bless America.”

It was a moving moment of patriotic bipartisanship. “It was our generation’s Pearl Harbor,” he recalled, and politics were momentarily subsumed by love of nation.

Then it was time to investigate and bring those responsible to justice.

“For many of us who were policymakers, it was time to take a crash course in understanding the tools of terrorism, trying to penetrate who al-Qaida was, who was this figure, Osama bin Laden – and then how do we respond?”

But the government went into overdrive, the Colorado Democrat believed, and put civil liberties at risk. He recalled other decisions in American history – such as the internment of Japanese-Americans during World War II – that were made in panic and secrecy.  

“It became clear to me that bin Laden’s motive was to create greater suspicion in the world, to incent us to build higher and higher walls,” he told a sold-out crowd at CEMEX Auditorium on Thursday night. His talk was part of Stanford “Security Conundrum” lecture series co-sponsored by CISAC, the Hoover Institution, the Law School, Stanford in Government and Continuing Studies.

“And in an interesting way, it led me to look at civil liberties and civil rights, which are the biggest, baddest weapons that we have,” he said in conversation with Philip Taubman, a CISAC consulting professor and a former reporter at The New York Times.

Taubman is one of the organizers of the special series has brought together nationally prominent experts this academic year to explore the critical issues raised by the National Security Agency's activities, including their impact on security, privacy and civil liberties.

On April 10, the speaker will be Judge Reggie Barnett Walton, former presiding judge of the Foreign Intelligence Surveillance Court, known as the FISA court. California Sen. Dianne Feinstein, vice chair of the Senate Intelligence Committee, will close the series before the end of the academic year.

Udall told the audience that in the powerful wake of fear that swept the nation following the 9/11 attacks, the House was presented with the Patriot Act “to strengthen and broaden our capacity to surveil those who might do us harm.”

Udall was a congressman from 1999 to 2009 and then senator from 2009 until losing his seat in the mid-term elections last year. He had been a one-term congressman when the Bush administration put the Patriot Act to a vote on Oct. 24, 2001.

He was one of only 66 House members to vote against the act. It would then also pass through the Senate the following day.

Udall called his no-vote an unpopular one and a lonely period of his political life. But he believed the Act had been hastily drafted without due process and that some of the law’s provisions could lead to violations of privacy and freedoms.

“I was very conscious of what Ben Franklin famously said. He said that a society that trades essential liberties for short-term security deserves neither,” Udall said. “And I believed that we were strong enough to stand behind the civil liberties included in the First Amendment, the Fourth Amendment and the Fifth Amendment – including the explicit right to privacy – and that we would outlast these adversaries that were in front of us by hewing to those principles, not abandoning those principles.”

Udall also voted against the Obama administration’s four-year extension of three key provision of the act in 2011, which included roving wiretaps, searches of business records and conducting surveillance of those suspected of terrorist-related activities.

He would then gain notoriety for his vocal opposition to NSA surveillance programs in the wake of the Edward Snowden disclosures of June 2013. He became one of the staunchest critics of the U.S. spy agency for conducting massive, warrantless data grabs on millions of Americans without their knowledge.

Udall said the NSA gathers more than 700 million data sets from phone calls each day.

“I was told, don’t worry Mark, this is metadata. We just collect it; we don’t do anything with it,” Udall said. “But I realized that it wasn’t just metadata, that it was how that metadata was being used and the fact that it was a secret program and under a secret interpretation of the law.”

Udall said the metadata can be manipulated for form a pattern of an individual’s behavior, of his religious and political beliefs, his medical issues, his likes and dislikes.

“We haven’t done anything with this data and that’s all well and good,” he said. “But history shows us that the government will overreach, particularly when it operates in secret. The Fourth Amendment was put in place for a reason.”

He also worries the metadata program has undercut the trust in the intelligence community.

“I want to be clear: We need to gather intelligence,” he said. “There are forces at play in the world that would do us great harm. But again, we ought to gather that intelligence in ways that fit with what the public understands.”

Udall called on the audience to push for transparency reforms to the FISA court – which oversees requests by the NSA and FBI to issue surveillance warrants against suspected foreign intelligence agents. From 1999 to 2012, the court has granted nearly 34,000 warrants; only 12 have been denied.

Udall believes that privacy, which is implicit in the Bill of Rights, is essential to all other American freedoms that are protected by law.

“This has long-term and important ramifications about how we look at ourselves as Americans,” he said. “We all need to be in the mix; we all need to be having these discussions to be ever-vigilant and protect these fundamental freedoms.”

ABSTRACT:

This study explores the relationship between elected representatives and the parties they belong to in the European context. It uses an elite cross-national survey, exploring the way elected representatives perceive their representative role and construct their perceptions of representation with regards to party unity. In order to bypass the "no-variance" problem in recorded votes, the study makes use of a legislator's sequential decision-making model, according to which party unity is not considered an end-result, but rather a process. Using attitudinal data on legislators’ perceptions and attitudes, the study shows that representatives often feel a tension between different, competing foci of representation – mainly party representation versus all other foci. It then examines how elected representatives reconcile this tension; how they are assisted by internalized perceptions of their role; and the effect of various institutional factors in this process.

Reut Itzkovitch-Malka is a visiting scholar at the Center on Democracy, Development and the Rule of Law at Stanford University. She is also a postdoctoral scholar from the Israel Institute. Her research interest centers on political representation from a comparative politics perspective, with a specific focus on the following two major topics. The first is legislative studies. Her main contribution in this regard is a large-scale, cross national comparative research focusing on legislators’ perceptions of representation and on the link between such perceptions and party unity. This research, which she conducted for her dissertation, uses a novel decision-making sequential model for the analysis of legislative attitudes and behavior. Using this model the research provides a first-time inside look into the dynamics surrounding party unity and allows us to gauge the importance of legislators’ representational role perceptions in shaping their behavior. Her second research interest revolves around gender and political representation. While investigating a broad range of issues related to gender and politics – such as women’s descriptive representation, the adoption of gender quotas for women and the gender gap in voting – Reut specializes in the substantive representation of women.

Reut received a Ph.D. in political science from the Hebrew University of Jerusalem in 2014, where she won the President Fellowship for outstanding doctoral students. She holds an M.A. with honors in political science from The Hebrew University of Jerusalem and a B.A with honors in political science and history also from The Hebrew University of Jerusalem.

Abstract

Latin America has gone through a major transformation in the past two decades. According to the United Nations, with the discovery of new oil and mineral deposits and increases in energy exports, manufacturing, and tourism, Latin America's economic growth and development will increase, and the region's global influence will become greater and greater.

In The Shared Society, Alejandro Toledo, whose tenure as president of Peru helped spur the country's economic renaissance, develops a plan for a future Latin America in which not only is its population much better off economically than today but the vast 40 percent of its poor and marginalized are incorporated into a rising middle class, democratic institutions work more effectively, and the extraordinary ecosystem of Latin America is preserved.

Alejandro Toledo served as the President of Peru from 2001 to 2006 and has been honored by the U.S. Senate for his policies during that tenure. He has held positions at the World Bank and the United Nations and was a Visiting Scholar in International Affairs at Harvard University as well as at Johns Hopkins University and a Senior Fellow and Distinguished Visiting Lecturer at Stanford University and the Brookings Institution. Toledo founded and continues to serve as the President of the Global Center for Development and Democracy in Washington, DC.

Koret Distinguished Lecture Series: Lecture VI

Facing increasingly daunting challenges at home and abroad, South Korea will hold its next presidential election in December 2017. At home, South Koreans are concerned about a rapidly aging society, imminent population decline, economic slowdown, and an inadequate social welfare net. Abroad, they worry about the strength of their alliance with the United States, confrontation among the countries of Northeast Asia over history and territorial issues, and military buildups in the region, including North Korea’s continuing pursuit of nuclear weapons. Thus, the 19th presidential election may prove to be the most important in Korea’s history. Yet problems with Korea’s current presidential system and candidate selection process are all too apparent. The Honorable Hyong O Kim, a former Speaker of Korea’s National Assembly who has been heavily engaged in many past presidential elections, will analyze the outlook for the 2017 presidential election and recommend ways of dealing with the weighty issues it entails.

Fei Yan, a postdoctoral fellow at the Walter H. Shorenstein Asia-Pacific Research Center, has been awarded a prize from the China and Inner Asia Council (CIAC) for his paper on political rivalries during China’s Cultural Revolution. The award aims to recognize emerging scholarship and foster intellectual exchange among experts working on China and Inner Asia topics, according to the award website.

Yan was presented the award at the Association for Asian Studies Annual Conference on March 27. CIAC released the following statement:

“In his paper, Fei Yan offers a new interpretation of the factional rivalries that wracked China's provinces during the early years of the Cultural Revolution. His focus is on the dispute between the so-called ‘radical’ Red Flag faction and the so-called ‘conservative’ East Wind faction that came to a head in Guangzhou in 1967. Making use of previously unavailable archival sources, he offers a meticulous and detailed description of the extent to which this split was based less on deep ideological differences and more on intense power rivalries and disagreements over tactics.”

Yan specializes in Chinese politics and political culture, and comparative social policy within transitional economies and authoritarian settings. He will join the Department of Political Science at Tsinghua University as an assistant professor this fall.

Retired Pakistani Lt. Gen. Khalid Kidwai told an audience of some 50 South Asia and nuclear experts at Stanford that India and Pakistan need a joint strategic vision to attain permanent peace and economic stability on the Subcontinent.

Kidwai, addressing a CISAC seminar on March 30, 2015, said the enmity between India and Pakistan - born from the partition of the subcontinent in 1947 that effectively divided Hindus and Muslims into two separate nations - will never be resolved until people are brought out of abject poverty.

"The obvious is not sinking into our regional calculations," he said. "The obvious is the elephant in the room: sustained socioeconomic progress."

More than 22 percent of Pakistan's 196 million people are living in poverty and 46 percent of its rural population falls below the global poverty line, according ot the Sustainable Development Policy Institute.

"Conflict resolution without socioeconomic progress will never work," said Kidwai, who is one of the most decorated generals in Pakistan. "There is no running away from this stark reality. For 68 years we have blustered and blundered our way through solutions, leaving 1.5 billion people condemned to hunger, filth and squalor."

He offered hope, in that there are two relatively new, democratically elected leaders now leading the nuclear-armed neighbors, which have gone to war three times since partition. Narendra Modi became India's 15th prime minister last year; Pakistan elected a new president, Nawaz Sharif, the year before that. They represent two political parties with strong elctroal mandates.

"We are waiting for the two leaderships to grasp, sit together, explore conflict resolution and go for it in a manner that all partners on all sides win," Kidwai said. "It needs vision, statesmanship and guts."

Kidwai is advisor to Pakistan's National Command Authority and was the inaugural director general of the country's Strategic Plans Division, which he headed for 15 years. He conceived and executed Islamabad's nuclear policy and deterrence doctrines. He also is the architect of Pakistan's civilian nuclear energy and space programs.

Kidwai, who was hosted by CISAC's Siegfried Hecker, told the Stanford audience that he wanted to dispel what he called "two fallacious counter-narratives that have taken root in our neighborhood."

The first, he said, is that Pakistan supports and conducts terrorism inside India. "What would Pakistan attempt to achieve from this strategy?" he said, adding that the Mumbai terrorist attacks of 2008 were not backed by Islamabad. On that day, 10 Pakistani men associated with the terrorist group Lashkar-e-Taiba killed 164 people during four days of attacks throughout the city. India has repeatedly accused Islamabad of supporting the terrorists; Islamabad said non-state actors were responsible for the attacks.

"Terrorism is not a Pakistani invention," he said. "What would Pakistan attempt to achieve from this strategy?" 

The second myth, he said, is that the Pakistani military purposely keeps tensions at a high boil in an effort to boost its defense budget.

"Nothing could be further from the truth," he said. "The Pakistan Army is all for an equitable, just and ordinary peace with India. We recognize that war is not an option."

Kidwai believes the presence of nuclear weapons in South Asia is a stabilizing force and that any new peace initiatives lay with India. 

India conducted its first "peaceful" nuclear explosion, code-named "Smiling Buddha," in May of 1974; it would then conduct five nuclear tests in May 1998. Seventeen days after the first of those tests, Islamabad announced that it had detonated six nuclear devices, which happened to match the Indian total.

Today, India is believed to have between 90 and 110 nuclear warheads; Pakistan has between 100 to 120, according to the Arms Control Association.

Kidwai said the tried-and-tested concept of Mutually Assured Destruction has maintained a tenuous truce between the two nations. MAD follows the theory of deterrence, where the threat of using nuclear weapons against the enemy prevents the enemy's use of those same weapons.

He considered the concept of space for limited conventional war highly problematic and explained that Pakistan opted to develop a variety of short-range, low-yield nuclear weapons as a defensive deterrence response to what he called an aggressive Indian doctrine.

Kidwai assured the Stanford audience that Pakistan's nuclear weapons were safe, secure and under complete institutional and professional control. 

"For the last 15 years, Pakistan has taken its nuclear security obligations very seriously," he said. "We have invested heavily in terms of money, manpower, weapons and preparedness."

Kidwai was challenged about the deterrence utility of tactical, or battlefield, nuclear weapons compared to the increased security and safety risks of their potential deployment. Although Kidwai made a convincing case for improved security of Pakistan's nuclear assets during his tenure at the Strategic Plans Division, concerns were nevertheless expressed because of Pakistan's challenging internal security environment.

Each year the Walter H. Shorenstein Asia-Pacific Research Center offers fellowship opportunities to recent graduates to further their research and engage with scholars at Stanford. Postdoctoral fellows have the opportunity to develop their dissertations for publication, present their research to the Stanford community, and participate in Center activities.

Darika Saingam

Saingam’s research interests are public health, substance abuse, drug policy and Southeast Asia. While at Shorenstein APARC, she will research the evolution of substance-abuse control measures and related policy in Thailand.

Saingam seeks to identify potentially effective policy directions suitable for Thailand, and other developing countries in Southeast and East Asia.

“There are a lot of lessons to be learned from substance abuse policy implementations in other countries…coping and dealing with substance abuse is a complex story and cannot respond successfully with only one strategy.”

Saingam completed her doctorate in epidemiology at the Prince of Songkla University in 2012, and has served as a researcher at the University’s epidemiology unit since, as well as a researcher at the Thailand Substance Abuse Academic Network since 2014.

Chang’s research interests are comparative policy analysis and political institutions in East Asia, mainly South Korea and Japan. While at Shorenstein APARC, Chang will conduct research on how countries respond differently to the same external challenges, and how institutions are interpreted and applied in different ways.

His dissertation, which he seeks to build upon, is titled “The Sources of Japanese Conduct: Asymmetric Security Dependence, Role Conceptions, and the Reactive Behavior in response to U.S. Demands.” It is a qualitative comparative case study of how key U.S. allies in Asia – namely Japan and South Korea – and major powers in Europe - the United Kingdom and France responded to the U.S.-led Persian Gulf War and the Iraq War.

“East Asia is a treasure island of new theory building because some of the big challenges facing East Asia – finding a new role for Japan, denuclearization of North Korea, unification of the Korean peninsula, democratization of China and reconfiguration of its relations with the world, and development and integration of Southeast Asian countries – are truly new ones…”

Chang completed his doctorate in political science from the Paul H. Nitze School of Advanced International Studies at Johns Hopkins University in 2014.

Nico Ravanilla

Ravanilla’s research interests are political economy and governance, comparative politics and Southeast Asia. While at Shorenstein APARC, Ravanilla will research how political selection impacts governance, and evaluate possible routes for incentivizing capable and virtuous citizens to run for public office.

His project titled “Nudging Good Politicians” looks at the case of the Sangguniang Kabataan, a governing body in the Philippines comprised of elected youth leaders. Ravanilla aims to apply his research to develop and scale up programs for politicians, especially those at the onset of their careers, which would include specialized leadership training and merit-based endorsement.

“If we could design a policy that screens-in and incentivizes competent and honest citizens to run for office, would it play a catalytic role in improving the quality of the political class, and ultimately, the quality of government?”

Ravanilla is also a Southeast Asia Research Group (SEAREG) Young Southeast Asia Fellow for 2015-16. He will complete his doctorate in political science and public policy from the University of Michigan in summer 2015.

Masako Mori (Liberal Democratic Party) is in her second term as a member of House of Councillors of Japan’s Diet (roughly equivalent of U.S. Senate).  She represents Fukushima prefecture.  From December 2012 to September 2014, she served as Minister in charge of Support for Women's Empowerment and Child-Rearing, Minister of State for Consumer Affairs and Food Safety, Minister of State for Declining Birthrate and for Gender Equality in the Cabinet led by Prime Minister Shinzo Abe.  As a central policy maker in Abe Administration’s “womenomics,” she will discuss the progress on women’s empowerment in Japan and the road ahead.

Abstract:

A democratic recession is underway across much of Africa. Ironically it coincides with sustained economic growth since 1998. Much of this growth derived from political and economic liberalization in the 1990s, that has accelerated over the past 15 years due to an upsurge in demand for Africa’s natural resources. GDP growth does not mean development, however, and deepening inequality is more easily politicised and militarized along identity lines by elites in an era where across the world the politics of identity is resurgent. Both the war against terror and the rise of the Chinese governance model – authoritarian but efficient and compelling politically and economically – have seen elites consolidate power in fewer hands stalling and/or reversing the democratic developments of the last two decades. This elite capture of democratic processes is not limited to the South and has led to a delegitimisation of traditional political parties and players. Additionally, the securitization of geopolitics that has accompanied the ‘war against terror’ has fed a dramatic upsurge in spending on ‘national security’. National security is the last refuge of the corrupt. Indeed, this securitization has been accompanied not only by an upsurge in graft but the ongoing democratic recession. My presentation asks why and how this has come about. Finally, how can democratic gains be protected, consolidated and expanded.

John Githongo is the CEO of Inuka, a non-governmental organisation involved in governance issues broadly defined, with an emphasis on working with and for ordinary Kenyans – youth in particular. In doing this Inuka is guided by the principles of heshima (respect), diversity (celebrating the depth and wealth of Kenya’s cultural diversity) and Ni Sisi! (It is us!) – for it is Kenyans who own and will ultimately resolve even the most seemingly intractable of their problems. John is also the Chairman of the Africa Institute for Governing with Integrity; Executive Vice Chair of the Mathare Youth Sports Association (MYSA); Chair board member of the Africa Center for Open Governance (AFRICOG); and a Commissioner of the Independent Commission on Aid Impact (ICAI) of the British government. Previously, he served as Vice President of World Vision, Senior Associate Member, St Antony’s College Oxford; Permanent Secretary in the Office of the President in charge of Governance and Ethics of the Kenya Government; board member Transparency International, Berlin, CEO Transparency International Kenya and a board member of the Kenya Human Rights Commission. In the past he has been a columnist for the EastAfrican, Associate Editor, Executive magazine; and a correspondent for the Economist. In 2004 the German President awarded him the German-Afrika Prize for Leadership. In 2011 he was selected as one of the world’s 100 most influential Africans by New African magazine and one of the world’s top 100 global thinkers by Foreign Policy magazine. In 2012 he was short-listed, alongside US Secretary of State, Hillary Clinton for the prestigious Tipperary International Peace Award.
