Rustin Crandall joined the Stanford Graduate School of Business as a full-time Administrative Associate in February 2013. Prior to coming to Stanford, he worked as an IT Coordinator for the Peace Corps in Guyana, a Program Coordinator for an international education and technology non-profit in New York, and a Product Manager for an Internet firm in the Philippines. Rustin will be supporting the Silicon Valley and China 2.0 projects through his communications, organization, and IT expertise.

Rustin holds a BA from UCLA and an MA from George Mason University.

John Montgomery

John Montgomery is a corporate attorney, entrepreneur, executive coach and writer. He is the founder of Montgomery & Hansen, LLP, a Silicon Valley based corporate law firm. He is also the founder of Startworks, a technology incubator. He works primarily with high-potential entrepreneurial teams to help them translate their visions into successful companies.

John recently received a California Lawyer of the Year award from California Lawyer magazine for his work as a co-chair of the legal working group behind California’s new benefit corporation law. A frequent speaker on venture capital, he has produced professional education programs for the State Bar on benefit corporations and for SmartPros/Cognistar: Understanding the Venture Capital Term Sheet Process and Introduction to Venture Capital Financing Agreements. Prior to founding Montgomery & Hansen in 2003, John was co-chairman of the venture capital practice at Brobeck, Phleger & Harrison, LLP. John is a student of non-dual philosophical systems, neuroscience, developmental theory and organizational development. In 2010, he co-founded Chrysallis, a human development company that aims to change the human development paradigm and support healthy, full, productive lives for billions of people.  His book, Great from the Start: How Conscious Corporations Attract Success, was published in May 2012. Montgomery has a BA (Studio Art) from Stanford University and a JD from Northwestern College of Law.

Jeff serves as Executive Director of BeingHuman.org and producer of Being Human events.

Abstract:

It has been said that constitutional court judges around the world increasingly participate in a "global judicial dialogue" that causes judges to make increased use of foreign law.  This is a dialogue, however, from which the members of the Taiwanese Constitutional Court are largely excluded.  Taiwan’s precarious diplomatic situation and intense lobbying by China have effectively prevented the members of Taiwan's Constitutional Court from participating in international judicial gatherings and official visits to foreign courts. Nevertheless, the Taiwanese Constitutional Court routinely engages in extensive consideration of foreign law, either expressly or implicitly, when deciding cases.  This fact casts doubt on the notion that "global judicial dialogue" explains judicial use of foreign law.  Comparison of the Taiwanese Constitutional Court and U.S. Supreme Court demonstrates that “global judicial dialogue” plays a much smaller role in shaping a court’s utilization of foreign law than institutional factors such as (a) the rules and practices governing the composition and staffing of the court and (b) the extent to which the structure of legal education and the legal profession incentivizes judges and academics to possess expertise in foreign law.

 

Speaker Bio:

David Law is Professor of Law and Professor of Political Science at Washington University in St. Louis and Visiting Professor at Georgetown University Law Center. He works in the areas of law and political science, public law, judicial behavior, comparative constitutional law, and comparative judicial politics. Born and raised in Canada, he holds a Ph.D. in political science from Stanford, a B.C.L. in European and Comparative Law from the University of Oxford, and a J.D. from Harvard Law School. He has previously taught at the University of San Diego School of Law and the University of California, San Diego political science department and has been a visiting professor at the National Taiwan University College of Law, Seoul National University School of Law, and Keio University Faculty of Law in Tokyo, and a visiting scholar at the NYU School of Law. His current research focuses on the identification, explanation, and prediction of global patterns in constitutional law, and his recent scholarship on constitutional globalization and the declining influence of the U.S. Constitution has been featured in a variety of domestic and international media.

More than 215 million people—approximately 3% of the world’s population—now live outside their country of birth (United Nations, 2009). Migration of individuals across international borders has socio-economic consequences both to the receiving and sending countries. One of the most important economic impacts of international migration is the amount of remittances sent home by migrants. World Bank (2011) estimated that developing countries received about $372 billion of remittances. Remittances serve as the second largest source of foreign reserves, next to exports of goods and services, for these countries. In addition, remittances benefit the poor households whose average income falls below the amount necessary to meet their most basic and non-food needs for the year.

This study focuses on the roles of international migration and remittances in the Philippines, which was ranked fourth in total international remittances received in 2009, after India, China, and Mexico (World Bank, 2012). The Philippine government refers to the temporary international workers or Overseas Filipino Workers (OFWs) as bagong bayani or new heroes. This epithet stems from the important roles that these migrant workers play: they often serve as the primary income providers for their families left in the Philippines, and their transfers are a source of foreign reserves for the Philippine economy.  

The colloquium presents evidence on three related research questions. The first is whether agricultural households in rural Philippines use remittances from OFWs, along with loans, and assets to mitigate the effect of negative shocks to their income. In particular, speaker Marjorie Pajaron will ask the question whether farmers depend on their network of family and friends when they encounter a natural disaster, like excessive rainfall or typhoon. The second is how migration affects the bargaining power within the household. Finally, she will discuss the remittance behavior of different types of migrants from the Philippines. 

Marjorie Pajaron joins the Walter H. Shorenstein Asia-Pacific Research Center during the 2012–13 academic year from the University of Hawai’i at Manoa Department of Economics where she served as a lecturer.

She took part for five years in the National Transfer Accounts project based in Honolulu. Her research focuses on the role of migrant remittances as a risk-coping mechanism, as well as the importance of bargaining power in the intra-household allocation of remittances in the Philippines. Pajaron received a PhD in economics from the University of Hawai’i at Manoa. 

Her recent working papers include: “Remittances, Informal Loans, and Assets as Risk-Coping Mechanisms: Evidence from Agricultural Households in Rural Philippines,” October 2012, Revise and Resubmit, Journal of Development Economics; “The Roles of Gender and Education on the Intra-household Allocations of Remittances of Filipino Migrant Workers,” June 2012; and “Are Motivations to Remit Altruism, Exchange, or Insurance? Evidence from the Philippines,” December 2011.

Selection from the report (Foreword by the commission co-chairs):

This report summarizes how America’s K-12 education system, taken as a whole, fails our nation and too many of our children. Our system does not distribute opportunity equitably. Our leaders decry but tolerate disparities in student outcomes that are not only unfair, but socially and economically dangerous. Our nation’s stated commitments to academic excellence are often eloquent but, without more, an insufficient response to challenges at home and globally. The data the commission reviewed make clear that officials, administrators and constituents at all levels of government must attack our education failings as a moral and economic
imperative.

What steps must we take in the years to come, and toward what ultimate destination? The direction of school reformers over the past 30 years has been guided by the polestar of world-class standards and test-based accountability. Our country’s effort to move in this direction has indeed led to important progress. But it has not been enough. The next stage of our journey will require coordinated reform efforts in all the states, and their 15,000 school districts, together with federal agencies—efforts focused on laying the foundations for far more widespread and equitable
opportunities for students throughout the nation. Out of many efforts, one united effort can create the opportunity that should be the birthright of each and every American child.

Early returns suggest that it may not be business as usual in state-society relations, with the Party-state being compelled to respond to an increasingly discontented and vocal society, and that a partial loosening of the tight censorship in media and culture may also be forthcoming. Indicators include changes in CCTV programming—e.g., a more interesting evening news report and the broadcast of the previously banned film V for Vendetta—media coverage of sensitive issues ranging from air pollution to the work of rights lawyers, and the relatively “enlightened” resolution of the Southern Weekend crisis, among other recent developments. What are we to make of these changes and, more importantly, how have these changes been received within China, for example on the ubiquitous and increasingly important Chinese microblogs?

Stanley Rosen is a professor of political science at USC specializing in Chinese politics and society and was the director of the East Asian Studies Center at USC’s Dornsife College of Letters, Arts and Sciences from 2005–2011. He studied Chinese in Taiwan and Hong Kong and has traveled to mainland China over 40 times over the last 30 years. His courses range from Chinese politics and Chinese film to political change in Asia, East Asian societies, comparative politics theory, and politics and film in comparative perspective. The author or editor of eight books and many articles, he has written on such topics as the Cultural Revolution, the Chinese legal system, public opinion, youth, gender, human rights, and film and the media. He is the co-editor of Chinese Education and Society and a frequent guest editor of other translation journals. His most recent books include Chinese Politics: State, Society and the Market [Routledge, 2010 (co-edited with Peter Hays Gries)] and Art, Politics and Commerce in Chinese Cinema [Hong Kong University Press, 2010 (co-edited with Ying Zhu)]. Other ongoing projects include a study of the changing attitudes and behavior of Chinese youth, and a study of Hollywood films in China and the prospects for Chinese films on the international market, particularly in the United States.

In addition to his academic activities at USC, Professor Rosen has escorted eleven delegations to China for the National Committee on U.S.-China Relations (including American university presidents, professional associations, and Fulbright groups), and consulted for the World Bank, the Ford Foundation, the United States Information Agency, the Los Angeles Public Defenders Office and a number of private corporations, film companies, law firms and U.S. government agencies.
