Few will dispute that the essence of our times can be conveyed by two simple words: " Global" and "Change". Economies, technologies, information, media, culture, and indeed security issues have been vastly internationalized and transformed in the incredibly short period of the half century following World War II . The world is being consumed by the forces of change driven by the engines of technology and geoeconomics. Economic change and technological development, like wars or sports, are usually not beneficial to all. Progress only benefits those groups of nations that are able to take advantage of newer methods of science, just as they damage those that are less prepared technologically, culturally, and politically to respond to change. Only societies free of rigid doctrinal orthodoxy and possessing attributes such as the freedoms to inquire, dispute, and experiment; a belief in the possibilities of improvement; a concern for the practical rather than the abstract; and rationalism that defies mandarin codes, religious dogmas, and traditional folklore, are likely to prosper in the new millennium. In any case, we must look with caution into the future. History teaches us that the only thing we can be certain of is that we will be surprised; our vision may well turn out to be distorted and myopic, our best guesses will often be wrong and we are likely to be disappointed in our expectations. We can only be certain of continuing conflict on a technology-driven planet with concurrent dwindling resources and increasing population.

As generally described, Japan's development of the internet industry has fallen behind even other Asian economies. Even though Japan's first trial of policy reformation in the mid 1980s was relatively early, what made this critical delay? Shin Yasunobe will present and evaluate Japan's policy track record in the 1990s. He will also present unique aspects of Internet development recently observed in Japan, and their implications for the future. Shin Yasunobe, formerly a high-ranking official with the Japanese Ministry of International Trade and Industry (MITI) has been appointed executive director at Stanford Japan CenterÑResearch, located in Kyoto. Yasunobe is a twenty-two year veteran of MITI who left his post as director of its Electronic Policy Division in the Machinery and Information Industries Bureau to take the reins of a new project at Stanford Japan CenterÑResearch. This project will be a set of comparative studies on the international dimensions of the Internet and e-commerce, with particular focus on the Asian economies.

Societies are becoming more dependent on computer networks and therefore more vulnerable to cyber crime and terrorism. Measures to protect information systems are receiving increasing attention as the threat of attack grows and the nature of that threat is better understood. The primary purpose of this article is to determine what legal standards should govern the use of such measures and what nontechnical constraints are likely to be placed, or should be placed, on them. The article demonstrates that policing of computer networks poses a real threat to privacy, protection against self-incrimination and unwarranted searches and seizures, and the right to due process of law. Technological realities and the differences in national values and rules concerning the intrusiveness of law enforcement, protection of citizen's rights, and international cooperation can complicate the observance of these rights and allow misuse of systems set up for preventing, tracking, or punishing cyber crime. Another purpose of this article is to show that while technologies of crime and punishment are undergoing a rapid and profound evolution, the legal and normative principles discussed here will endure, because they are independent of specific technology. As such, they can provide a framework for building a global infrastructure and policy environment that can balance the needs for crime-free business, government, and personal communications, with the protection of property, privacy, and civil liberties. The article concludes that ensuring civil liberties in the course of legal and technological cooperation against cyber attacks is essential.

How much security is enough? No one today can satisfactorily answer this question for computer-related risks. The first generation of computer security risk modelers struggled with issues arising out of their binary view of security, ensnaring them in an endless web of assessment, disagreement, and gridlock. Even as professional risk managers wrest responsibility away from the first-generation technologists, they are still unable to answer the question with sufficient quantitative rigor. Their efforts are handicapped by a reliance on non-quantitative methodologies originally developed to address the deployment and organizational acceptance issues that plagued first-generation tools.

In this report, I argue that these second-generation approaches are only temporary solutions to the computer security risk-management problem and will eventually yield to decision-focused, quantitative, analytic techniques. Using quantitative decision analysis, I propose a candidate modeling approach that explicitly incorporates uncertainty and flexibly allows for varying degrees of modeling detail to address many of the failings of previous modeling paradigms. Because quantitative modeling requires data, I also present a compilation and critique of publicly available computer security data. I highlight the importance of data collection, sharing, and standardization with discussions of measurement, relevance, terminology, competition, and liability. I conclude with a case study example, demonstrating how uncertain data and expert judgments are used in the proposed modeling framework to give meaningful guidance to risk managers and ultimately to answer the question: How much is enough?

Henry S. Rowen was a senior fellow at the Hoover Institution, a professor of public policy and management emeritus at Stanford University's Graduate School of Business, and a senior fellow emeritus of the Walter H. Shorenstein Asia-Pacific Research Center (Shorenstein APARC). Rowen was an expert on international security, economic development, and high tech industries in the United States and Asia. His most current research focused on the rise of Asia in high technologies.

In 2004 and 2005, Rowen served on the Presidential Commission on the Intelligence of the United States Regarding Weapons of Mass Destruction. From 2001 to 2004, he served on the Secretary of Defense Policy Advisory Board. Rowen was assistant secretary of defense for international security affairs in the U.S. Department of Defense from 1989 to 1991. He was also chairman of the National Intelligence Council from 1981 to 1983. Rowen served as president of the RAND Corporation from 1967 to 1972, and was assistant director of the U.S. Bureau of the Budget from 1965 to 1966.

Rowen most recently co-edited Greater China's Quest for Innovation (Shorenstein APARC, 2008). He also co-edited Making IT: The Rise of Asia in High Tech (Stanford University Press, 2006) and The Silicon Valley Edge: A Habitat for Innovation and Entrepreneurship (2000). Rowen's other books include Prospects for Peace in South Asia (edited with Rafiq Dossani) and Behind East Asian Growth: The Political and Social Foundations of Prosperity (1998). Among his articles are "The Short March: China's Road to Democracy," in National Interest (1996); "Inchon in the Desert: My Rejected Plan," in National Interest (1995); and "The Tide underneath the 'Third Wave,'" in Journal of Democracy (1995).

Born in Boston in 1925, Rowen earned a bachelors degree in industrial management from the Massachusetts Institute of Technology in 1949 and a masters in economics from Oxford University in 1955.

Rafiq Dossani was a senior research scholar at Stanford University's Shorenstein Asia-Pacific Research Center (Shorenstein APARC) and erstwhile director of the Stanford Center for South Asia. His research interests include South Asian security, government, higher education, technology, and business.  

Dossani’s most recent book is Knowledge Perspectives of New Product Development, co-edited with D. Assimakopoulos and E. Carayannis, published in 2011 by Springer. His earlier books include Does South Asia Exist?, published in 2010 by Shorenstein APARC; India Arriving, published in 2007 by AMACOM Books/American Management Association (reprinted in India in 2008 by McGraw-Hill, and in China in 2009 by Oriental Publishing House); Prospects for Peace in South Asia, co-edited with Henry Rowen, published in 2005 by Stanford University Press; and Telecommunications Reform in India, published in 2002 by Greenwood Press. One book is under preparation: Higher Education in the BRIC Countries, co-authored with Martin Carnoy and others, to be published in 2012.

Dossani currently chairs FOCUS USA, a non-profit organization that supports emergency relief in the developing world. Between 2004 and 2010, he was a trustee of Hidden Villa, a non-profit educational organization in the Bay Area. He also serves on the board of the Industry Studies Association, and is chair of the Industry Studies Association Annual Conference for 2010–12.

Earlier, Dossani worked for the Robert Fleming Investment Banking group, first as CEO of its India operations and later as head of its San Francisco operations. He also previously served as the chairman and CEO of a stockbroking firm on the OTCEI stock exchange in India, as the deputy editor of Business India Weekly, and as a professor of finance at Pennsylvania State University.

Dossani holds a BA in economics from St. Stephen's College, New Delhi, India; an MBA from the Indian Institute of Management, Calcutta, India; and a PhD in finance from Northwestern University.

In 2005, India will implement new intellectual property (IP) laws that recognize product patents on pharmaceuticals. Because India's 1970 Patent Act only recognizes process patents, Indian drug companies have been free to copy molecules from multinational companies (MNCs), to sell within India and other nonpatent conforming markets. New laws, such as the Exclusive Marketing Rights amendment to the 1970 Patent Act (ratified on April 19, 1999), will substantially alter this practice. This paper discusses what companies are doing to prepare for 2005 and beyond. As is the case today, Indian and MNCs alike will figure prominently in the future of the pharmaceutical sector, albeit in somewhat altered form. Although the new patent regime has the potential to reward MNCs at the expense of Indian firms, local companies will likely benefit from stricter laws. In fact, it is plausible that the 2005 laws will vault some Indian pharmaceutical companies into globally prominent positions.
