Emily Arnold-Fernández was a social entrepreneur in residence during the fall 2012 quarter with CDDRL's Program on Social Entrepreneurship. She will be spending the 2013/14 academic year as a practitioner-in-residence with the Program on Social Entrepreneurship.

She is the founder and executive director of Asylum Access, is a social entrepreneur and human rights pioneer. Recognizing that refugees throughout Africa, Asia and Latin America – some of whom flee with nothing more than the clothes on their backs – were almost always unequipped to go into a legal proceeding in a foreign country, alone, and explain why they should not be deported, Emily founded Asylum Access to advocate on behalf of refugees seeking to assert their rights.

“For half a century, international law has given refugees the rights to live safely,
seek employment, send children to school and rebuild their lives. But those rights are
meaningless unless they are respected on the ground,” she says. “Asylum Access
provides a rare opportunity to fill a gaping hole in our human rights system – by making
refugee rights a reality for real people.”

For her innovative approach to the global refugee crisis, Emily was honored by the
Dalai Lama as one of 50 “Unsung Heroes of Compassion” from around the world (2009)
and Waldzell Institute’s Architects of the Future Award (2012). She has also been
recognized as Pomona College’s Inspirational Young Alumna (2006), awarded the
prestigious Echoing Green fellowship (2007), and recognized as the New Leaders
Council’s 40 Under 40 (2010), among others. Emily’s ground-breaking work with
Asylum Access has earned her international speaking invitations and widespread media
attention, including the Rotary International Peace Symposium (2008, 2009), the UN
High Commissioner for Refugees’ Annual Consultations (2008, 2009), a cover feature in
the Christian Science Monitor (September 2009), and the San Francisco Examiner’s
Credo column (July 2011). She holds a B.A. cum laude from Pomona College and a J.D.
from Georgetown University Law Center.

Committed to sharing her knowledge with young and aspiring social
entrepreneurs, Emily serves as an adjunct professor at the University of San Francisco,
teaching a course in social entrepreneurship. In Fall 2012, Emily was selected as one of
three Social Entrepreneurs in Residence at Stanford where she participated as “expert
respondent” in Stanford Law School’s Law, Social Entrepreneurship and Social Change
course, and in Spring 2013, Emily led an intensive skills-building course on social
entrepreneurship at Pomona College.

A visionary human rights activist, Emily Arnold-Fernández takes her inspiration
from a line in a June Jordan poem: “We are the ones we have been waiting for.”

Abstract: 

Do human rights institutions work? To answer this question we examine the effect of these institutions on two kinds of outcomes: physical integrity rights (freedom from torture, government-sponsored killing, political imprisonment, and the like) and civil and political rights (freedoms of speech, assembly, movement, and religion, as well as voting and workers' rights). Our analysis covers up to 143 countries, including some of the world's worst abusers, over the period 1981 to 2004. We arrive at two main conclusions. First, national human rights institutions improve physical integrity outcomes but not civil and political rights practices. This finding reflects a greater worldwide focus on extreme violations such as torture, but also points to widespread resistance among non-Western governments to "Western" civil and political rights standards. Second, we find that time matters: the establishment of a human rights institution contributed initially to greater reports of physical integrity abuses, but practices improved significantly after only four or five years. These institutions shine a bright spotlight on countries negative practices, making it more likely that abuses are detected and cataloged. Over time, however, they help to curb egregious human rights violations. Our findings suggest that human rights institutions are not just futile exercises in governmental hypocrisy; rather, they work to improve human rights practices regardless of the intent of governments.

Francisco Ramirez is Professor of Education and (by courtesy) Sociology at Stanford University where he is also the Associate Dean for Faculty Affairs in the Graduate School of Education. His current research interests focus on the rise and institutionalization of human rights and human rights education, on the worldwide rationalization of university structures and processes, on terms of inclusion issues as regards gender and education, and on the scope and intensity of the authority of science in society. His comparative studies contribute to sociology of education, political sociology, sociology of gender, and sociology of development. His work has contributed to the development of the world society perspective in the social sciences. Ramirez received his BA in social sciences from De La Salle University in the Philippines and his MA and PhD in sociology from Stanford University.

Wade Cole is Assistant Professor of Sociology at the University of Utah. His current work focuses on (1) the impact of global human rights norms, treaties, and institutions on a range of country-level practices including bodily integrity rights, civil and political rights, labor rights, women’s rights, racial discrimination, measures of wellbeing, and governmental redistributive efforts; and (2) the rise and possible demise of minority-serving and women’s colleges in the United States, with an interest in how the varied and often contradictory ways that African Americans, American Indians, Hispanics, and women were incorporated into the American polity shaped the emergence, development, and purposes of postsecondary institutions catering to these groups. Cole holds a BA in political science from Western Washington University and a PhD in sociology from Stanford University.

Abstract:

In less than three decades, Taiwan has transformed from a repressive, authoritarian state into a vibrant democracy. Changes to the legal system, and particularly the criminal justice system, have played a central role in this story. Reform-minded politicians, lawyers, judges, prosecutors, and scholars have been crucial advocates for strengthening human rights protections, as has Taiwan’s Constitutional Court. Since the end of martial law, the Court has vigorously given heft to rights enshrined in the Republic of China’s constitution. Now that Taiwan has adopted the contents of the International Covenant on Civil and Political Rights as domestic law, it is an opportune moment to reflect on Taiwan’s journey towards embracing international human rights norms and to confront remaining challenges. The situation across the strait is markedly different. Today, Taiwan’s Constitutional Court has no counterpart on the Mainland and analogues to Taiwan’s former police-controlled punishments remain in full effect. As calls for reform on the Mainland become increasingly vocal, how might Taiwan’s experience inform efforts to increase human rights protections in the People’s Republic of China?

Maggie Lewis joined Seton Hall Law School as an Associate Professor in 2009. She is a Term Member of the Council on Foreign Relations, a Public Intellectuals Program Fellow with the National Committee on U.S.-China Relations, and an Affiliated Scholar of NYU School of Law’s U.S.-Asia Law Institute. Her recent publications have appeared in the Columbia Journal of Transnational Law, NYU Journal of International Law and Politics, Columbia Journal of Asian Law, and Virginia Journal of International Law. She is also the co-author of the book Challenge to China: How Taiwan Abolished Its Version of Re-Education Through Labor with Jerome A. Cohen. 

Most recently before joining Seton Hall, Professor Lewis served as a Senior Research Fellow at NYU School of Law’s U.S.-Asia Law Institute where she worked on criminal justice reforms in China. Following graduation from law school, she worked as an associate at the law firm of Cleary, Gottlieb, Steen & Hamilton in New York City. She then served as a law clerk for the Honorable M. Margaret McKeown of the U.S. Court of Appeals for the Ninth Circuit in San Diego. After clerking, she returned to NYU School of Law and was awarded a Furman Fellowship.

Professor Lewis received her J.D., magna cum laude, from NYU School of Law, where she was inducted into the Order of the Coif and was a member of Law Review. She received her B.A., summa cum laude, from Columbia University. In addition, she has studied at the Hopkins-Nanjing Center for Chinese and American Studies in Nanjing, China, and Bucerius Law School in Hamburg, Germany.

This event is being presented in partnership with CDDRL, the U.S. Holocaust Memorial Museum, the Hoover Institution, and a student led movement to end atrocities at Stanford (STAND).

Abstract:

Sixty-eight years after the Holocaust, governments continue to struggle with preventing genocide and mass atrocities. In 2005, United Nations member states agreed that nations share a responsibility to protect their citizens from genocide, crimes against humanity, war crimes, and ethnic cleansing. Join us for a discussion about how the responsibility to protect (or R2P) has been applied in recent crises.

 

Speakers bio:

Richard Williamson is a nonresident senior fellow in Foreign Policy at Brookings and a principal in the consulting firm Salisbury Strategies LLP. His work focuses on human rights, multilateral diplomacy, nuclear nonproliferation and post-conflict reconstruction. Prior to those positions, Mr. Williamson served as U.S. special envoy to Sudan, under President George W. Bush. Earlier in the Bush administration, Mr. Williamson, who has broad foreign policy and negotiating experience, served as ambassador to the United Nations for Special Political Affairs, and as ambassador to the U.N. Commission on Human Rights. Previously, Mr. Williamson served in several other senior foreign policy positions under Presidents Ronald Reagan and George H.W. Bush, including as assistant secretary of state for international organizations at the Department of State, and as an assistant to the president for intergovernmental affairs in the White House.

Michael Abramowitz is director of the Center for the Prevention of Genocide at the U.S. Holocaust Memorial Museum. He joined the Museum in 2009 after nearly 25 years at the Washington Post, where he served as White House correspondent and previously as national editor, helping supervise coverage of national politics, the federal government, social policy, and national security. He is a member of the Council on Foreign Relations and a non-resident fellow of the German Marshall Fund. He was also a media fellow at the Hoover Institution at Stanford University.

Tod Lindberg is a research fellow at the Hoover Institution, Stanford University, based in Hoover’s Washington, DC, office. His areas of research are political theory, international relations, national security policy, and US politics. 

Lindberg is a contributing editor to the Weekly Standard and an adjunct associate professor at Georgetown University, where he teaches in the School of Foreign Service. From 1999 until it ceased publication in 2013, he was editor of the bimonthly journal Policy Review.

In 2007–8, Lindberg served as head of the expert group on international norms and institutions of the Genocide Prevention Task Force, a joint project of the U.S. Holocaust Memorial Museum, the American Academy of Diplomacy, and the U.S. Institute of Peace. In 2005, Lindberg was the coordinator for the group Preventing and Responding to Genocide and Major Human Rights Abuses for the United States Institute of Peace's Task Force on the United Nations. He was a member of the Steering Committee of the Princeton Project on National Security, for which he served as cochair of the working group on anti-Americanism. He is a member of the Council on Foreign Relations.

Lina Khatib is the co-founding Head of the Program on Arab Reform and Democracy at the Center on Democracy, Development, and the Rule of Law at Stanford University. She joined Stanford University in 2010 from the University of London where she was an Associate Professor. Her research is firmly interdisciplinary and focuses on the intersections of politics, media, and social factors in relation to the politics of the Middle East. She is also a consultant on Middle East politics and media and has published widely on topics such as new media and Islamism, US public diplomacy towards the Middle East, and political media and conflict in the Arab world, as well as on the political dynamics in Lebanon and Iran. She has an active interest in the link between track two dialogue and democratization policy. She is also a Research Associate at SOAS, University of London, and, from 2010-2012, was a Research Fellow at the USC Center on Public Diplomacy at the Annenberg School.

Anna West is a 2013-14 pre-doctoral fellow at CDDRL and a PhD candidate in the Department of Anthropology at Stanford. Her dissertation research in Malawi examines how modular global health interventions engage local power structures, patronage systems, and political cultures. Anna combines ethnographic fieldwork and archival research on encounters between government outreach workers, village heads, and rural households to trace the salience of health promotion strategies for the formation and consolidation of ideas, values, and processes of governance and democracy in Malawi. Her work focuses in particular on traditional authorities' involvement in rural health promotion and the significance of chiefly governance for local and national discourse on community participation, human rights, and citizenship. Anna's research has been supported by the National Science Foundation, the Fulbright U.S. Student Program, a U.S. State Department FLAS Fellowship, and Stanford's Center for African Studies.

A tremendous amount of radioactive products were discharged as a result of the accident at the Fukushima nuclear power plant in March 2011, which resulted in radioactive contamination of the plant and surrounding areas. While geographical distribution of radioactive iodine, tellurium, and cesium in the surface soils was smoothly (but not always systematically) widespread all over the region, health risk information by the government, media, and other organizations is most likely to be given in terms of administrative boundaries (cf. prefectures, municipalities, etc.) and/or distance from the radiation source.

This paper estimates the effect of such health risk information rather than the actual health risks of radiation on land and other prices in different locations. We find that the prefecture and municipality border effects – but not the distance effect from the nuclear power plant – are significantly related to a reduction in land and other prices after the accident. This shows that people responded to health risk information based on administrative boundaries rather than the actual health risk of radiation after the disaster. Although health risk information based on prefecture and municipality boundaries has an obvious advantage of distilling large and complex risk information into a simple one, the government, media, and other organizations need to recognize and carefully examine the potential of misclassifying non-contaminated areas into contaminated prefectures. Doing so will avoid unintentional consequences to the region’s economy.

Hiroaki Matsuura is currently Departmental Lecturer in the Economy of Japan in the School of Interdisciplinary Area Studies, University of Oxford and a Junior Research Fellow of St. Antony’s College. His main interests are health economics and demography, with a special interest in the relation between laws and population health. Hiroaki received his B.A. in Economics from Keio University, M.A. in Social Science from the University of Chicago, M.S. in Project Management from Northwestern University’s McCormick School of Engineering and Applied Science, and Sc.D. in Global Health and Population (Economics track) from Harvard University’s School of Public Health. In the past, he was affiliated with Institute of Quantitative Social Sciences, Human Rights in Development, and Takemi Program in International Health at Harvard University. He also worked as a research assistant at the National Bureau of Economic Research. His doctoral dissertation research explores a right to health or to health care in national constitutions of 157 countries and state constitutions of the 50 U.S. states and estimates the impact of introducing (or removing) a right to health or to health care into national and state constitutions on health system and population health outcomes. His most recent article, “The Right to Health in Japan: Challenges of a Super Aging Society and Implication from Its 2011 Public Health Emergency” (with Eriko Sase) will be appeared on “Advancing the Human Right to Health”, edited by José M. Zuniga, Stephen P. Marks, and Lawrence O. Gostin, Oxford University Press, 2013.

Diane H. Steinberg is a visiting scholar at the Center on Democracy, Development, and the Rule of Law at Stanford University’s Freeman Spogli Institute for International Studies, and she is affiliated with Stanford’s Division of International, Comparative and Area Studies.  She provides instructional assistance to California community college faculty, who are selected to be Fellows in the Stanford Human Rights Education Initiative program, as they develop college-level interdisciplinary curricula related to international human rights.  She also serves as the Online Forum Coordinator for the Human Rights & International Criminal Law Online Forum.  Since 2003, Dr. Steinberg has been Research Director for Ed Research Group, an independent education research organization that evaluates the effectiveness of educational programs and policies.  Her recent research has focused on school reform policies that advance high quality, equitable education in urban school districts.  She has consulted with local, state, and federal government agencies and contributed to independent reviews of school desegregation plans for the Federal District Court in Northern California.  Dr. Steinberg received a B.A. in Psychology with honors and distinction from Stanford University, an M.A. in Education from the Stanford Graduate School of Education, and a Ph.D. in Education from the University of California, Berkeley.

Through periods of colonial expansion, New World emigration, postcolonial immigration, and Eurozone migration, Europe has been shaped and reshaped by the constant movement of people and communities within and across its borders. The Europe Center supports scholarship that explicates the socio-political, economic, and cultural consequences of migration for both states that receive immigrants and states that send emigrants.

The event will be a dialogue with Justice Sachs about contemporary human rights challenges in South Sfrica and the role South Africa plays in the region. It will be moderated by David Palumbo- Liu, professor of Comparative Literature at Stanford University and Tim Stanton, director of the Overses Studies Program at Stanford University will be a discussant.

Sachs will also be offering guest lectures in Professor Helen Stacy’s course, INTNLREL 144: New Global Human Rights, and ANTHRO 125S: International Criminal Courts and the Question of Global Justice with Professor Ron Jennings. Albert Sachs’s career in human rights activism started when he was 17 years old, continuing through college and into his law practice in Cape Town. In defending people charged under the state’s racist statutes, he attracted the displeasure of authorities and was initially subjected to “banning laws” restricting his activities, then arrested, and finally put into solitary confinement. Upon release from prison, he went into voluntary exile but never discontinued his human rights work. In 1988 in Mozambique, Sachs lost his arm and the sight of one eye when a bomb placed under his car by South African security agents exploded, but emerged from the ordeal with renewed idealism for his cause and what he describes as simple joy at being alive.

In 1990, Sachs returned to South Africa, where he worked to draft the constitution for the newly democratic country. In 1994, he was appointed by Nelson Mandela to the Constitutional Court, where he served as judge until 2009, writing decisions that changed the face of human rights in South Africa, including a decision against the death penalty in 1995, a decision in favor of same-sex marriage in 2005, and several significant decisions about health care, access to clean water, housing and infrastructure.

He is the author of Soft Vengence of a Freedom Fighter, wich chronicles his response tothe 1988 car bombing, and five other books including The Jail Diary of Albie Sachs, which was dramatized for the Royal Shakespeare Company and broadcast by the BBC.
