In recent years "Muslim democracy" has emerged as a new political reality in a number of Muslim countries with open politics to define the role of Islam in democracy. Muslim democracy evokes the legacy of Christian Democratic parties of Europe in that it is an electoral platform that seeks to dominate the middle by integrating Muslim values into broader socioeconomic demands. Muslim democracy is not a platform for religious reform nor a theoretical construct, but rather the product of politics on the ground and the give-and-take of electoral politics. Muslim democracy has taken shape in the political process by Islamist parties such as Turkey's AKP, and non-religious parties such as Pakistan's PML. It provides a point of departure for discussing democratization and pragmatic change across the Muslim world, and in particular contending with outcome of recent elections in Iran, Iraq and the Palestinian territories.

Is civil war likely to break out in Iraq? It already has, according to CISAC's James D. Fearon, a political science professor who studies recent civil wars. Fearon is among four experts Time asked to comment on the current violence in Iraq.

In looking at the brewing civil war between the two groups in Iraq, it's easy to assume that the cause is ancient hatred. Nothing could be further from the truth. For the overwhelming majority of Iraqi history, Sunnis and Shi'ites have lived peacefully side by side, and numerous Iraqis are the children of mixed marriages. Instead we are witnessing in Iraq what occurs when government collapses and there is no state around capable of guaranteeing personal security.

What do you do when your family is in peril and you cannot turn to the government for protection? The answer is that you will take security wherever you can get it. You need to find some group that will be capable of keeping you safe, and that group had better be one that can count on your loyalty just as you can count on its protection. If you are a member of my ethnic, racial or religious group, then we share at least some basic bond, which may be enough to ensure our loyalty to one another. I need some assurance that you will have my back, and identity is better than nothing.

Sunnis and Shi'ites may find themselves joining militias or supporting denomination-based political parties even if they are not particularly pious and would much prefer not to. Something similar happened in the former Yugoslavia when its government collapsed with the fall of communism and nothing replaced it. Ethnic activists - call them identity entrepreneurs - will always form the core of the new militia. These radicals will emphasize symbols, like al-Askari mosque that was blown up last week in Iraq, and hope that followers will react by strengthening their commitments to the group itself.

Is it possible to break the cycle of violence that gets under way when identity groups move toward civil war? One answer is for an outside force to impose a solution. The killing did not stop in Bosnia or Kosovo until Western powers showed they were willing to bomb. But this approach is not viable in Iraq, where U.S. bombs came first and civil strife has followed. Instead the only way out of the violence is for Iraqis to realize that they have more to gain by negotiating a settlement between their groups than they do by allowing a full-blown brothers' war to break out.

What lies at the heart of the sectarian violence in Iraq is not so much religious dispute as it is a very secular competition for power and prominence in the new Iraq. Iraq is not all that different from Northern Ireland or Bosnia, where religion paraded as ethnicity and became a vehicle for communal rivalries. In the vacuum of power left by the fall of Saddam Hussein, the game of numbers has favored Shi'as, who are 60% of the population. It is for this reason that they wholeheartedly embraced democracy. Disgruntled Sunnis, on the other hand, vested their fortunes in boycott and violence, hoping that as spoilers, they would gain leverage in negotiating over the future.

Few in the West recognized the depth of either the Shi'a anger at the Saddam regime or the Sunni rage born of loss of power. There is a strong sense of Iraqi identity among both Shi'as and Sunnis, but as strong allegiance to sect and ethnicity in every election has shown, a shared notion of what Iraqi identity means and how each community sees the future of Iraq is fast disappearing. As happened in Bosnia, in Iraq mixed marriages and shared memory of coexistence will not be enough to stop internecine violence.

Shi'as embraced the political process that the U.S. set in place in 2003 in the hope that it would guarantee their security and serve their interests. There is indication now that many Shi'as are having second thoughts. Already overstretched in facing the Sunni insurgency, the U.S. can hardly afford losing the Shi'a as well. If tensions escalate to a full-blown civil war, Iran, Saudi Arabia, Jordan and Syria may all join the war to protect their co-sectarians and to scramble for pieces of a failed Iraq.

Pulling Iraq back from the brink will be difficult. Building a strong central government and an effective security force will help. The challenge is to get them up and running before events on the ground pass a point of no return.

By any reasonable definition, there has been a civil war in progress in Iraq at least since the Coalition Provisional Authority formally handed over authority to the Iraqis in 2004. A civil war is a violent conflict within a country fought between organized groups seeking to compel a major change in government policies or to take control of the center or a region. The insurgents in Iraq target the U.S. military, but they are also fighting against the Shi'ite-dominated Iraqi government and killing large numbers of Iraqis. There is little reason to think that if the U.S. suddenly withdrew, the insurgents would not continue to fight to control or shape the government.

When we hear talk about incipient civil war in Iraq, the fear is of an escalation of the current insurgency into a much bigger war. Analysts may have in mind something like the U.S. Civil War, with Sunni and Shi'ite armies fighting each other across well-defined fronts. Or they may imagine a sudden spasm of massive communal conflict and ethnic cleansing along the lines of Bosnia or Rwanda. Neither scenario is all that likely, although bouts of violent ethnic cleansing are certainly possible in a few parts of the country, especially Kirkuk.

My guess would be that as the insurgency continues to create insecurity, sectarian militias will continue to grow in power and influence. They will increasingly supply local security, but in the form of protection rackets that extort as they protect. They will clash with each other over territory and control of revenue sources. Since the Sunnis remain highly disorganized, some of these local fights may initially be intra-Shi'ite. But in the absence of effective political incorporation and protection from national police and army units - which are heavily infiltrated by Shi'ite militias - Sunnis will gradually form a patchwork of militias. Neighborhood-by-neighborhood conflict and violence will increase. Think Lebanon.

If you look at the ethnic conflicts and street demonstrations during Iraq's modern history, it is remarkable how few have involved Shi'ites fighting Sunnis. During the colonial era, Iraqis were united by their opposition to the British occupation. Sunni and Shi'ite tribes cooperated in rebelling against British rule, and were only put down with a bombing campaign in 1920 that killed 9,000. In 1941 mobs targeted Iraq's small Jewish population; Jews had been a valued part of the Iraqi national fabric but were accused, unfairly, of being pro-colonial. After World War II, much of the violence in Iraq was fueled by issues of class. In 1948 slum dwellers and railway and oil workers revolted against a government treaty with Britain. In 1959, Arab nationalists assassinated Communist Party members, while mobs in Mosul and Kirkuk attacked and killed rich businessmen and landowners.

Iraqi Muslims have not all along been severely divided by religious sect. There have been many instances of strong cooperation between Sunnis and Shi'ites. Other social divides have led to mob violence in the past, but Iraqis have overcome them to re-establish national unity. It remains to be seen whether they can accomplish this feat again.

Since the controversy over cartoons of the Prophet Muhammad erupted, Europe's leaders have shown remarkable--and uncharacteristic--courage under fire. Refusing to apologize for the alleged slight to religious Muslims, a chorus of Continental voices has instead risen to the cartoons' defense, citing freedom of expression as the very essence of liberty, democracy and the European Way.

Unfortunately, free speech is about the weakest card in Europe's hand these days. An Austrian court's conviction and sentencing of the British historian David Irving to three years imprisonment for Holocaust denial is merely the most recent footnote to European hypocrisy on freedom of expression over the past decade.

The European Convention on Human Rights, which legally binds all EU states and supersedes domestic law, explicitly guarantees "the right to freedom of expression" including "the freedom to hold opinions and to receive and impart information and ideas without interference by public authority."

This provision is in keeping not only with the U.S. Bill of Rights, but with the central instruments of international human rights law to which Europe and America claim adherence. Yet Europe's interpretation of free expression has diverged markedly from America's broad deference to First Amendment freedoms of speech, assembly and religion.

American courts have upheld the publication of false, even racist materials, the right of neo-Nazis to rally in Jewish neighborhoods, and the objections of some citizens to the Pledge of Allegiance and to school dress codes on religious grounds.

European governments, on the other hand, have consistently trampled analogous rights, outlawing publication of hate speech, trade in Nazi paraphernalia, and the wearing of distinctive religious clothing, to name but a few recent examples.

According to the Austrian court that convicted him on Monday, David Irving's offense was to have "denied, grossly played down, approved, or tried to excuse" the Holocaust in print or other media, in violation of a 1992 statute. Although he has not been tried at home in Britain, Irving was convicted and fined in Germany in 1995 for "inciting race hatred."

At best, Irving is a monumentally terrible historian, who, only after publishing dozens of books on World War II, read the notes of the Holocaust mastermind Adolf Eichmann and came around to admitting that the Nazi genocide might actually have occurred. At worst, he is an artless but unrepentant bigot, on the model of America's David Duke or Austria's own Jörg Haider, but without any independent political power.

Why, then, is Irving's Holocaust denial, like other minority and extremist views in European society, of such great concern to lawmakers? If European governments want to guard against the repetition of genocide, they should actively educate their citizens in tolerance and respect for different cultures and beliefs, not gag those who express conflicting ideas.

Europe's suppression of free speech is guaranteed to spawn and incubate precisely the kind of bigotry and sectarian violence it is intended to prevent. Hounded for the unthinkable crime of publishing false history, David Irving appears almost heroic as he stands up to censorship, fines and imprisonment, making him a kind of martyr for neo-fascist groups.

Likewise, suppression of young Muslims' rights to dress or worship as their religion requires lends government sanction to already widespread anti- Muslim attitudes. This official xenophobia in turn breeds simmering resentment that has already exploded into mass violence and been manipulated by radical Islamists to recruit willing terrorist agents from within European society.

While European leaders should be praised for their belated conversion to the cause of free speech, outraged Muslims around the world are right to allege a double standard. Until Europe consistently respects its own guarantees of free expression, and actively promotes tolerance instead of clumsily stifling dissent, its brave rhetoric will ring disappointingly false.

Martin Krygier is Professor of Law at the University of New South Wales, Sydney, Australia, co-director of the European Law Centre, and a Fellow of the Academy of Social Sciences in Australia. He studied philosophy, politics, and law, and his doctorate is in the history of ideas. In June 2005 he was appointed recurrent visiting professor at the Centre for Social Studies, Academy of Sciences, Warsaw, and at present he is a Fellow at the Center for Advanced Study in the Behavioral Sciences, Stanford University.

His work spans a number of fields, including legal, political and social philosophy; communist and post-communist studies; sociology of law; the history of ideas. His work has been translated into French, Hungarian, Italian, Polish, Romanian, Spanish and Ukrainian. Apart from academic publications, he also writes for journals of public debate.

A book of his selected essays, Civil Passions, was published in July 2005. Two co-edited books have also appeared recently: Rethinking the Rule of Law after Communism (Central European University Press, Budapest) and Spreading Democracy and the Rule of Law? (Springer, Berlin). In 1997, he was invited to deliver the Boyer radio lectures for the Australian Broadcasting Commission. This resulted in a book, Between Fear and Hope: Hybrid Thoughts on Public Values.

SELECT Magazine's contributing editor talks to Rafiq Dossani about outsourcing, one of the hottest and most controversial topics in the global IT industry.

SELECT: What is the current size of the outsourcing market? What percent of U.S. software development, call centers, etc., have already moved to developing nations? Is the amount of outsourcing still increasing?

Dossani: To provide some perspective, although the off-shoring of services has been going on for mans Nears, technology led by the widespread use of the Internet has changed things. The resulting new twist in the provision of services is that the required interaction between the seller and the consumer has been substantially limited. The advances in information technology made possible the parsing of the provision of certain services into components requiring different levels of skill and interactivity As a result, certain portions of the serviced activity that might or might not be skill-intensive, but required low levels of face-to-face interaction could be relocated offshore. The sequence of events that enabled this process is the following:

    First, the digital age allowed (or, at least, revolutionized) the conversion of service flows into stocks of information, making it possible to store a service. For example, a legal opinion that earlier had to be delivered to the client in person could now be prepared as a computer document and transmitted to the client via e-mail or, better yet, encoded into software. Easy storage and transmission allowed for the physical separation of the client and vendor as well as their separation in time. It also induced the separation of services into components that were standardized and could be prepared in advance (such as a template for a legal opinion) and other components that were customized for the client (such as the opinion itself) or remained non-storable. Taking advantage of the possibility of subdividing tasks and the economies that come with the division of labor, this reduced costs by offering the possibility of preparing the standardized components with lower-cost

    labor and, possibly at another location.

    The second fundamental impact of digitization was the conversion of non-information service flows into information service flows. For example, the sampling of tangible goods by a buyer through visiting a showroom is increasingly being replaced by virtual samples delivered over the Internet. Once converted to an information flow, the service may also he converted into a stock of information and subjected to the above mentioned forces of cost reduction through standardization of components and remote production.

    Third, the low-cost transmission of the digitized material accelerated the off-shoring of services. Services such as writing software programs which were off-shored to India in the early 1970s were enabled by digitized storage and, in the 1980s, by the standardization of programming languages. Still later, as digital transmission costs fell in

    the 1990s (just as digital storage costs had fallen earlier), even nonstorable

    services, such as customer care, could he handled offshore.

The offshore services outsourcing market (excluding software development) is still small and will probably be approximately $10 billion for 2005. It employs about 500,000 people, two thirds of whom are located in India. The rest are widely distributed, with developing Asia and Ireland accounting for most of the remaining employment. About 60% of the employment is in call centers. The U.S. and U.K. call-center industry together employ about five million people, so the percentage of offshore jobs is still small. It is even smaller for other services.

Offshore software development employs approximately another 500,000 people. This compares with U.S. employment of about two million. This is a larger percentage of the total software development labor market. although most of the outsourced work is programming, while work such as systems integration and design continue to be done in the U.S.

The growth rate is still high and there are concerns about whether or not this rapid growth rate will hurt the quality of work done. However. this rate will still likely he in excess of 30% in 2005 and 2006. The reason for this is the massive wage differential.

Clearly there have been massive failures as well as outstanding successes in outsourcing. What are the critical success factors for making outsourcing work?

The infrastructure (telecom. finance, power) has all been standardized, although the solutions might not he the same as in developed countries. The critical success factors are two: the quality of labor and supervision; and managing growth. Unbelievable there is a growing shortage of labor. The result is that the quality of work is declining. Project supervisory skills are also in short supply. Managing growth, especially keeping attrition

under control, training, developing new vertical skills, moving into back-office work, and offering the client turnkey packages are some of the critical managerial factors for success.

Short of being willing to work for $15,000/year, what can western IT professionals do to provide sufficient value to prevent their functions from being outsourced?

The U.S. educational system still turns out a good product. It is sufficiently ahead of the comparable Indian product so that a recent computer science/computer engineering graduate from the average U.S. university can earn a premium of at least 100% over his Indian counterpart from a good university such as the IlTs, with substantially higher premiums for graduates from schools such as MIT and Stanford. The problem occurs more with mid-career professionals. Those with older skills are unable to compete with freshly trained graduates from India. Therefore, they need to update those skills regularly and take advantage of opportunities to globalize and convert them into managerial skills. This may have to he mandated at some point, as has happened in the financial sector, where stockbrokers need to regularly sit for exams to renew their licenses.

That said, most of the offshore jobs are relatively low-skilled. For example, the single largest category of offshore services is outbound calling for the financial services industry for selling mortgages or collecting overdue receivables. The work is routine, based on scripts that pop-up on the computer screen in response to prompts.

Do these findings suggest that developed countries are likely to be only marginally threatened by the globalization of services? Even if high-end work is stays within developed countries, as has happened in the software industry, the problem is that not everyone in developed countries can readily shift to high-end work. Since the 1960s, the shift in the economies of developed nations towards service-based economies certainly increased the number of highly-skilled service workers, but there was an even greater swelling in the number of other less-skilled service workers. This is partly a consequence of the nature of many services as linked, inseparable sets of activities with different

skill levels, combined with a pyramid of labor requirements, i.e., there is more demand for lower-level work than for high-end work. In manufacturing. the unemployment created by the reduction in demand for blue collar labor in developed countries was offset by the absorption of much of the surplus labor into service industries, often with minimal training. But the shift of low-end service workers to high-end workers will require a longer period of re-education and may have significant interim consequences on unemployment rates.

The threat to developed countries is increased by the fact that, apart from software, the largest growth in off-shoring is happening in business services. These are also the sectors with the largest growth in U.S. employment.

Further, there is evidence that even higher skilled functions can be moved offshore or might evolve on their own. For example, interviews with people at a firm earlier this year revealed that they had initially been contracted by an American firm to call its clients with overdue credit card payments. The offshore company eventually purchased the receivables from its client and assumed the collection risk itself. Another firm, Wipro Spectramind, managed the radiology services of Massachusetts General Hospital for its second and third shifts. Thus, American radiologists, who earn an average of $315,000 a year were replaced by Indian radiologists, who earn $20,000 a year on average.

I understand that there is a whole subculture in Pakistan and India of people who go to work in the late afternoon or evening and then work a full day on U.S. time. What effect has outsourcing had on the cultures of the countries that are recipients of much of the outsourced work? Have labor rates dramatically increased? Is it difficult for local companies in India and Pakistan to get quality IT talent?

Indeed such a subculture now exists. It is viewed as very stressful work and not suitable for a long-term career. Companies that do such work try to ameliorate the stress by hiring psychiatric counselors to provide free counseling to stressed-out employees. They also provide free meals and transportation, sports facilities, etc.

However, labor rates have increased only, a little. This is more than offset by

the rise in productivity of this labor over time.

Outsourcing is clearly a temporary solution. As labor rates equalize, the benefit of outsourcing decreases. In Pakistan and China, there are still huge differences in labor costs, but in Turkey, rates are closer to what they are in the 11.5. and other Western states. Realistically, how long can we gain a significant benefit form outsourcing?

India and China, and to some extent, Pakistan, have large labor pools. That is why, in manufacturing, Chinese wage rates have not changed despite massive employment growth over the past three decades. I think that wage rates in India will actually fall because of increasing supply, which is being drawn into outsourcing. This would mean several more decades of benefit from outsourcing.

One way in which developed countries may retain value is if their firms control the work done, either through providing the risk capital or through subsidiaries. While it is difficult to predict which organizational types will dominate, a number of firm-specific factors that influence the liability of off-shoring and organization structure are summarized here:

    The knowledge component of the activity. A higher knowledge component makes the firm more concerned about whether the quality of the service will change due to a location change or the transfer process.

    The interactive components of the process.

    The ability to modularize the process

    Savings from concentrating an activity in one location, leading to

    benefits of scale and scope.

    Reengineering as part of the transfer process. To transfer a business process, it is necessary to study it intensively and script the transfer. In the process of study, often there will he aspects of the current methodology for discharging the process that do not add value. Very often these aspects are legacies of earlier methodologies that were not eliminated as the production process evolved. During the act of transfer these are easier to abandon than at an existing facility' where they have become a "natural' part of the daily routine. Our interviews identified other unexpected benefits that go beyond the efficiency effects. Simply examining the business processes may reveal previously undetected inefficiencies. During the transfer process, these inefficiencies can be addressed without disrupting work patterns. Workers in the new location then use the reengineered process which is usually more efficient.

    The time-sensitive nature of the work.

This talk scrutinizes the relationship between individual attitudes towards democracy and such contextual characteristics as the institutional framework and the level of socioeconomic development. For this purpose the individual evaluation of a democratic rule, experts rule, army rule, and a strong leader rule is considered. The analysis discovers a strong relationship between the individual political attitudes and different contextual factors. In particular, it turns out that pre-democratic views vary at both the national and the regional level. Democratic values, on the other hand, are rather evenly distributed within countries but also vary among countries. One finding is that the socioeconomic level has a strong impact on the occurrence of pre-democratic values. For those holding strong democratic beliefs, institutional factors such as the absence of an authoritarian regime in the recent past become more important than the socioeconomic level.

He is the founder and director of the Democracy and Rule of Law Project which analyzes the state of democracy in the world and the efforts by the United States and other countries to promote democracy. In addition, he has broad experience in matters dealing with human rights, international law, foreign aid, rule of law, and civil society development. He is the author or editor of six critically acclaimed books on democracy promotion as well as many articles in prominent journals and newspapers. Since the accession of ten new member states the European Union has launched a new effort to draw its neighbors, from Ukraine to Morocco, closer to the EU. This engagement goes beyond trade and aid to include participation in various internal EU policies and programs but stops short of offering full membership. Economic and political governance are high on the agenda. Bertin Martens will explain how this effort reinforces previous policies and could contribute to real change in the political and economic landscape around the EU.

Bertin Martens is Regional Economist for the Middle East & South Mediterranean in the European Commission's Directorate General for External Relations. He joined the European Commission in 1990 and has worked on various assignments in Africa, Asia and Eastern Europe before. He holds a PhD in Economics from the Free University of Brussels and has been a Visiting Fellow at George Mason and Stanford universities. His academic research interests focus on institutional economics and governance.
