Opponents of immigration reform see illegal immigrants as criminals who will disregard U.S. laws once in the country, writes Frank Fukuyama in the Wall Street Journal, but they are better described as "informal" rather than "illegal." Reform that provides hardworking illegal immigrants with a path to citizenship should be seen as an effort to move people from a dangerous informal system to one based on a rule of law.

There is a widespread perception of a strong link between immigrants and crime. It is common to hear those who oppose immigration argue that the first act illegal immigrants commit on U.S. soil is to break the law-that is, our immigration laws-and that they are ipso facto criminals who will continue to disregard U.S. laws once in the country. Those making this argument are generally steadfastly opposed to any immigration reform that will provide the 10 million to 12 million illegals already in the country any path to citizenship, on the grounds that such an "amnesty" would reward law-breaking.

The association of immigrants with crime is strengthened by the weekly barrage of news about drug and gang violence in Mexico as the government of Mexican President Felipe Calderón seeks to crack down on that country's powerful drug mafias. And long before the Mexican drug war, Americans were threatened by Colombian cartels, Salvadoran street gangs, and other criminal groups from Latin America. Moreover, it is perfectly true that the simple fact of being an illegal immigrant induces one to break further laws: One is reluctant to buy mandated auto insurance, pay taxes, or register businesses for fear of deportation.

There is indeed a huge problem of crime originating in Latin America and spilling into the United States. This is almost wholly driven by the enormous demand for drugs from the U.S. There are many things we can and should do to mitigate this problem, but it will persist as long as that demand remains high.

But the problem of gangs and drug violence should not be confounded with the behavior of the vast majority of illegal immigrants to the U.S., who by and large are seeking the same thing that every immigrant to America has wanted since the time of the Mayflower: to better their condition and that of their families. They are not criminals in the sense of people who make a living by breaking the law. They would be happy to live legally, but they come from societies in which legal rules were never quite extended to them. They are therefore better described as "informal" rather than "illegal."

Understanding this distinction requires knowing something about the social order in Latin America or, for that matter, in many other developing countries. These societies are often characterized by sharp class distinctions between a relatively small, well-educated elite and a much broader and poorer population.

The rule of law exists in places like Mexico, Colombia and El Salvador; the problem is that access to the legal system tends to be a privilege of the well-to-do. The vast majority of illegal immigrants to the U.S. come from poor rural areas, or shantytowns in large cities, where the state-in the form of courts, government agencies and the like-is often absent. Registering a small business, or seeking help from the police, or negotiating a contract requires money, time and political influence that the poor do not possess. In many Latin American countries, as much as 70%-80% of the population lives and works in the informal sector.

The lack of legal access does not make everyone in these regions criminals. It simply means that they get by as best they can through informal institutions they themselves create. The Peruvian economist Hernando de Soto has written extensively about the lack of formal property rights, not just in his own country but throughout the developing world. The poor do not hold legal title to their homes, despite having lived in them for years, because of the insuperable barriers the system throws up to formal registration. So they squat in their homes, constantly insecure and unable to use their property as collateral.

The poor are entrepreneurial and form businesses like restaurants and bus companies, but they are unlicensed and don't conform to official safety rules. They and everyone else would be much better off if they could be brought into the formal legal system, but it is a dysfunctional political system that prevents that from happening.

What illegal immigrants to the U.S. have done is to recreate the informal system within our borders. The Americans who hire them are often complicit in this system by not providing benefits or helping them avoid taxes through cash payments. The gardeners and maids and busboys who participate in this game, along with their employers, are indeed breaking the law. But they are in a very different category from the tattooed Salvatrucha gang member who lives by extortion and drug-dealing.

A comprehensive immigration reform that provides hardworking illegal immigrants with an ultimate path to citizenship should not be regarded as rewarding criminal behavior. It should be seen as an effort to move people from a dangerous informal system to one characterized by a modern rule of law.

We need, of course, to control much better the total number of people coming into the country, which can ultimately be done only through stronger enforcement of employment rules. If we can better distinguish between illegal and informal in our political discourse, then we can begin to concentrate our resources on going after those in the immigrant population who are genuinely dangerous criminals.

Each year the program's Post Doctoral Fellows have the opportunity, as part of their appointment, to teach the Stanford course which includes recent work in political theory on global justice. The course is designed to encourage students to think critically about some of the important questions regarding such issues as global poverty, human rights, fair trade, immigration and climate change. Questions include: Do developed countries have a duty to aid developing countries? When is humanitarian intervention justified? and Is torture ever justified? Readings include Charles Beitz, Thomas Pogge and John Rawls.

Kieran Oberman is a post-doctoral fellow in the Program on Global Justice and the Center for Ethics in Society at Stanford Univeristy.  He completed his PhD at Oxford University in 2009.  His thesis,  "Immigration and Freedom of Movement," argued that people have a human right to freedom of movement that entails a right to cross  international borders. Before coming to Stanford he held a short post-doctorate position at the University of Louvain in Belgium.  While at Stanford he has continued his work on the ethical issues surrounding international migration.  His article, "Immigration, Global Poverty and the Right to Stay", which argues against using migration as a means to address global poverty, is forthcoming in Political Studies.

President Barack Obama announced his intent to appoint CISAC's Mariano-Florentino Cuéllar, an expert on federal regulatory policy, public safety, and international security, to the Council of the Administrative Conference of the United States (ACUS), an independent agency of the United States government charged with improving the efficiency and fairness of federal agencies.

Professor Cuéllar, who is both a CISAC faculty member and the Deane F. Johnson Faculty Scholar at Stanford Law School, recently returned from a leave of absence he took to serve as Special Assistant to the President for Justice and Regulatory Policy at the White House Domestic Policy Council. Among other issues, Cuéllar worked on improving food safety and public health policy, expanding support to state and local law enforcement, enhancing transparency in the regulatory process, and strengthening border coordination and immigrant integration. He negotiated key provisions of the Family Smoking Prevention and Tobacco Control Act and represented the Domestic Policy Council in the development of the first-ever Quadrennial Homeland Security Review. Earlier, Cuéllar co-chaired the Obama Transition's Immigration Policy Committee and served as a Treasury official in the Clinton Administration.

As part of the ACUS Council, Cuéllar will join leading lawyers such as former U.S. court of appeals judge Patricia Wald and former solicitor general Ted Olson in overseeing the work of ACUS and setting its priorities. With the appointment to the ACUS Council, Cuéllar will draw upon his scholarly expertise in how institutions manage complex regulatory challenges as well as his experience in government.

"At a time when our country faces such enormous challenges, it is especially important for agencies to safeguard the rights of the public, cut waste, and deliver value to the American people," said Cuéllar. "I am honored by this appointment and by the chance to work on these critical issues."

Established by statute in 1964, the Administrative Conference of the United States has played an important role in promoting improvements in the efficiency and fairness in the way federal agencies conduct regulatory programs. ACUS has been on hiatus for the past 14 years, but has been revived by Congress with support from a broad range of lawyers, scholars, and judges, including Supreme Court Justices Antonin Scalia and Stephen Breyer.

Exponential advances in the life sciences, particularly in the realm of biotechnology, have been held to raise the classic concerns of "dual-use" research: the same technologies that propel scientific advances critical to human health, the environment and economic growth also could be misused to develop biological weapons, including for bioterrorism.  However, there is significant disagreement as to whether this depiction appropriately frames the nature of the problem.  Some scientists have characterized the prevailing policy discourse on the life sciences as the "half-pipe of doom," a bipolar approach that artificially disaggregates and decontextualizes the promise and peril of advances in the life sciences.  The panel will discuss proposals to address such concerns, focusing on whether the Intergovernmental Panel on Climate Change (IPCC) offers a transferable model of scientific and policy consensus-building for issues of safety and security of biotechnology.      

Stephen J. Stedman joined CISAC in 1997 as a senior research scholar, and was named a senior fellow at FSI and CISAC and professor of political science (by courtesy) in 2002. He served as the center's acting co-director for the 2002-2003 academic year. Currently he directs the Ford Dorsey Program in International Policy Studies at Stanford and CISAC's Interschool Honors Program in International Security Studies. His current research addresses the future of international organizations and institutions, an area of study inspired by his recent work at the United Nations. In the fall of 2003 he was recruited to serve as the research director of the U.N. High-Level Panel on Threats, Challenges and Change. Upon completion of the panel's report, A More Secure World: Our Shared Responsibility, Annan asked Stedman to stay on at the U.N. as a special advisor with the rank of assistant secretary-general, to help gain worldwide support in implementing the panel's recommendations. Following the U.N. world leaders' summit in September 2005, during which more than 175 heads of state agreed upon a global security agenda developed from the panel's work, Stedman returned to CISAC. Before coming to Stanford, Stedman was an associate professor of African studies at the Johns Hopkins University School of Advanced International Studies in Washington, D.C. He has served as a consultant to the United Nations on issues of peacekeeping in civil war, light weapons proliferation and conflict in Africa, and preventive diplomacy. In 2000 Scott Sagan and he founded the CISAC Interschool Honors Program in International Security Studies. Stedman received his PhD in political science from Stanford University in 1988.

Donald Kennedy is the editor-in-chief of Science, the journal of the American Association for the Advancement of Science, and a CESP senior fellow by courtesy. His present research program entails policy on such trans-boundary environmental problems as: major land-use changes; economically-driven alterations in agricultural practice; global climate change; and the development of regulatory policies.

Kennedy has served on the faculty of Stanford University from 1960 to the present. From 1980 to 1992 he served as President of Stanford University. He was Commissioner of the US Food and Drug Administration from 1977-79. Previously at Stanford, he was as director of the Program in Human Biology from 1973-1977 and chair of the Department of Biology from 1964-1972.

Kennedy is a member of the National Academy of Sciences, the American Academy of Arts and Sciences, and the American Philosophical Society. He served on the National Commission for Public Service and the Carnegie Commission on Science, Technology and Government, and as a founding director of the Health Effects Institute. He currently serves as a director of the Carnegie Endowment for International Peace, and as co-chair of the National Academies' Project on Science, Technology and Law. Kennedy received AB and PhD degrees in biology from Harvard University.

Drew Endy is a synthetic biologist with the Stanford Department of Bioengineering. He was a junior fellow and later an assistant professor in the Department of Biological Engineering at MIT prior to coming to Stanford in September 2008 as an assistant professor in the Department of Bioengineering. Endy's research focus is on synthetic biology. With researchers at MIT he works on the engineering of standardized biological components, devices, and parts, collectively known as "BioBricks." He is one of several founders of the Registry of Standard Biological Parts, and invented an abstraction hierarchy for integrated genetic systems. Endy is known for his opposition to limited ownership and supports free access to genetic information. He has been one of the early promoters of open-source biology, and helped to start the Biobricks Foundation, a non-profit supporting open-source biology.

Tarun Chhabra is a JD candidate and Paul and Daisy Soros Fellow at Harvard Law School, and a doctoral candidate in international relations at Oxford University.  Tarun previously worked in the Executive Office of UN Secretary-General Kofi Annan, and on the staff of Annan's High-level Panel on Threats, Challenges and Change.  He also served as a consultant-advisor to the Norwegian Foreign Ministry on nuclear non-proliferation and disarmament initiatives. He was a Fulbright Scholar in Russia at the Moscow State Institute for International Relations (MGIMO) and received a Marshall Scholarship to study at Merton College, Oxford, where he earned a MPhil in international relations and was an instructor in international relations at Stanford House.  He holds a BA from Stanford University, where he worked at the Martin Luther King, Jr., Papers Project and was in the honors program at CISAC. Tarun is a Fellow of the Truman National Security Project and a member of the International Institute for Strategic Studies.

Chris Field is the founding director of the Carnegie Institution's Department of Global Ecology, Professor of Biology and Environmental Earth System Science at Stanford University, and Faculty Director of Stanford's Jasper Ridge Biological Preserve. He also is co-chair of Working Group 2 of the Intergovernmental Panel on Climate Change (IPCC) and will lead the fifth assessment report on climate change impacts, adaptation, and vulnerability.  The author of more than 200 scientific publications, Field’s research emphasizes impacts of climate change, from the molecular to the global scale. Field’s work with models includes studies on the global distribution of carbon sources and sinks, and studies on environmental consequences of expanding biomass energy. Field has served on many national and international committees related to global ecology and climate change and was a coordinating lead author for the fourth assessment report of the Intergovernmental Panel on Climate Change. Field has testified before House and Senate committees and has appeared on media from NPR “Science Friday” to BBC “Your World Today”. He is a member of the US National Academy of Sciences. Field received his PhD from Stanford in 1981 and has been at the Carnegie Institution for Science since 1984.

Stephen Stedman is a Senior Fellow at the Freeman Spogli Institute for International Studies (FSI) and the Center on Democracy, Development and the Rule of Law (CDDRL), an affiliated faculty member at CISAC, and professor of political science (by courtesy) at Stanford University. He is director of CDDRL's Fisher Family Honors Program in Democracy, Development and Rule of Law, and will be faculty director of the Program on International Relations in the School of Humanities and Sciences effective Fall 2025.

In 2011-12 Professor Stedman served as the Director for the Global Commission on Elections, Democracy, and Security, a body of eminent persons tasked with developing recommendations on promoting and protecting the integrity of elections and international electoral assistance. The Commission is a joint project of the Kofi Annan Foundation and International IDEA, an intergovernmental organization that works on international democracy and electoral assistance.

In 2003-04 Professor Stedman was Research Director of the United Nations High-level Panel on Threats, Challenges and Change and was a principal drafter of the Panel’s report, A More Secure World: Our Shared Responsibility.

In 2005 he served as Assistant Secretary-General and Special Advisor to the Secretary- General of the United Nations, with responsibility for working with governments to adopt the Panel’s recommendations for strengthening collective security and for implementing changes within the United Nations Secretariat, including the creation of a Peacebuilding Support Office, a Counter Terrorism Task Force, and a Policy Committee to act as a cabinet to the Secretary-General.

His most recent book, with Bruce Jones and Carlos Pascual, is Power and Responsibility: Creating International Order in an Era of Transnational Threats (Washington DC: Brookings Institution, 2009).

Chris Field is the Perry L. McCarty Director of the Stanford Woods Institute for the Environment.

His research focuses on climate change, ranging from work on improving climate models, to prospects for renewable energy systems, to community organizations that can minimize the risk of a tragedy of the commons.

Field has been deeply involved with national and international scale efforts to advance science and assessment related to global ecology and climate change. He served as co-chair of Working Group II of the Intergovernmental Panel on Climate Change from 2008-2015, where he led the effort on the IPCC Special Report on “Managing the Risks of Extreme Events and Disasters to Advance Climate Change Adaptation” (2012) and the Working Group II contribution to the IPCC Fifth Assessment Report (2014) on Impacts, Adaptation, and Vulnerability.

Field assumed leadership of the Stanford Woods Institute for the Environment in September 2016. His other appointments at Stanford University include serving as the Melvin and Joan Lane Professor for Interdisciplinary Environmental Studies in the School of Humanities and Sciences; Professor of Earth System Science in the School of Earth, Energy & Environmental Sciences; and Senior Fellow with the Precourt Institute for Energy. Prior to his appointment as Woods' Perry L. McCarty Director, Field served as director of the Carnegie Institution for Science's Department of Global Ecology, which he founded in 2002. Field's tenure at the Carnegie Institution dates back to 1984.

His widely cited work has earned many recognitions, including election to the U.S. National Academy of Sciences, the Max Planck Research Award, the American Geophysical Union’s Roger Revelle Medal and the Stephen H. Schneider Award for Outstanding Science Communication. He is a fellow of the American Academy of Arts and Sciences, the American Association for the Advancement of Science, and the Ecological Society of America.

Field holds a bachelor’s degree in biology from Harvard College and earned his Ph.D. in biology from Stanford in 1981.

Angela Merkel was sworn in as Chancellor on November 22, 2005. She is the first woman and the first East German to hold this office. From 2002-2005, Chancellor Merkel was the Chairwoman of the Christian Democratic Union (CDU) parliamentary group in the German Bundestag. She has been the Chairwoman of the Christian Democratic Union since 2000, and served as the General Secretary of the CDU from 1998 to 2000. In 2007, Merkel was the President of the European Council and chaired the G8, participating in the negotiation of the Treaty of Lisbon and the Berlin Declaration. In 2008, Nicolas Sarkozy presented Merkel the Charlemagne Prize for her work to reform the European Union.

Viewed from the realist perspective of mainstream international political economy, economic and elite-based political integration are the keys to building a region; “soft” or “normative” questions of identity can be ignored.  Contesting that view, Dr. Pietsch will argue that research on regionalism, especially in Southeast Asia, could benefit from a focus on the nature and role of national and regional identity in that process. Compared with the growing body of scholarship on European identity as a means of understanding “Europeanization,” regional identity in Southeast Asia is still underexplored. Addressing this gap is important especially in relation to issues of democratization such as human rights, migrant labor, access to citizenship, environmental sustainability, gender equality, and corruption. These questions necessarily invoke national cultural and political values and their implications for regional identity.

Drawing on relevant theories, Dr Pietsch will use AsiaBarometer data to examine public opinion on democratization, national identity, and regional cooperation in Southeast Asia. Her preliminary findings underscore the need to broaden scholarship on regionalism in Southeast Asia to encompass both cultural and political manifestations of identity. In addition, she will show how identity helps explain why ASEAN-style regionalism is often thought by analysts to have succeeded in economic and security terms but to have failed in the consciousness of Southeast Asians themselves.

Dr. Juliet Pietsch is a senior lecturer in political science in the Australian National University’s School of Politics and International Relations. She studies broad patterns of social and political behaviour in Australia and East Asia. Recent publications include Dimensions of Australian Society (co-authored, 2010), and "Generational Change: Regional Security and Australian Engagement with Asia," The Pacific Review (co-authored, 2010).

"Freedom and solidarity and partnership belong together," German Chancellor Angela Merkel told a capacity crowd at Stanford on April 15 in her only public speech during a four-day visit to the United States. "They must be indivisible for us to master the challenges ahead." Merkel was introduced by Stanford President Emeritus Gerhard Casper who said the Chancellor was considered to be "among the most powerful, most thoughtful, and most principled stateswomen and statesmen in the world." In her speech, Merkel chose to address "21st century responsibilities which can only be successfully met by acting together," with a focus on the common global security challenge, addressing the international financial and economic crisis effectively, and meeting the challenge of climate change and global warming, which she termed "one of the great challenges of mankind."

Twenty years have passed since the Berlin Wall fell and Angela Merkel – then a budding politician who grew up in communist East Germany – first saw the potential and promise of a free world.

Now the chancellor of Germany, Merkel says freedom can only flourish with international cooperation aimed at making the world safer, cleaner and more economically stable.

"Freedom and solidarity and partnership belong together," Merkel told a capacity crowd at Stanford's Dinkelspiel Auditorium on Thursday after being introduced by President Emeritus Gerhard Casper. "They must be indivisible for us to be able to master the challenges ahead."

But Merkel's speech – the only one she delivered during a four-day trip to the United States – showed that those alliances often come at a cost. Speaking hours after four German troops were killed in fighting in Afghanistan, Merkel expressed her condolences while calling the war a "mission that guarantees our freedom and security."

"It is a sad experience for us in Germany," she said. "It is an experience we share with you in the United States."

With polls showing the war becoming increasingly unpopular in Germany, Merkel said she accepts and respects "doubts" about whether the conflict is necessary or right. But her commitment to fighting the war is unwavering.

She told the audience at Dinkelspiel that the fallout of the international financial crisis "will be with us for a long time to come." But strengthening global trade agreements, steering away from protectionism and bolstering innovation will put financial markets back on the right course, she said.

European financial woes are a volatile topic in Germany right now. The country has offered to pitch in about $11 billion for a Greek economic rescue package, a move that has sparked criticism of Merkel's government.
The bailout poses a serious political risk, as Merkel’s political party faces regional elections in Germany's biggest state on May 9. The party of Christian Democrats must win in order to maintain its majority in the Bundesrat, parliament's upper house.

Merkel did not directly address the Greek economic situation during her speech, but she did stress the need for countries to work together and share responsibility for strengthening the world's financial future.
"We need a new global financial architecture," she said. "We need rules that prevent a whole community of nations from being damaged because individuals have made mistakes."

She said the players behind the world's largest markets have to take an interest in emerging economies and "sit down and reflect together with them" how to establish a strong and prosperous global economy.

A scientist by training, Merkel earned a doctorate in physics and worked as a chemist at a scientific academy in East Berlin. While she was a student, Stanford "was just a far, far-away scientific paradise unreachable from behind the Iron Curtain." And when the Berlin Wall came down, she found herself pulled to a life of politics.

But first, she and her husband celebrated their newfound freedom by doing what they had long dreamed of. They visited California. The chancellor reminisced about the trip as she concluded her speech at Dinkelspiel, standing in front of a backdrop displaying Stanford's German motto: Die Luft der Freiheit weht.

The wind of freedom blows.
